Ms. Michelotti still wanted to look at the permitting process and keeping some of the existing conditions. She felt the direction was not to significantly expand the allowable locations and protect the City at the same time. It was moved by Mr. Hco, and seconded by Ms. Ayala, to maintain the current zoning ordinance concerning extrasensory consulting. The roll call vote was as follows: AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico and Mayor Tarver. NOES: None ABSENT: None ABSTAIN: None It was moved by Mr. Pico, and seconded by Ms. Dennis, that Ordinance No. 1770 be introdnced, to be read by title only and waiving further reading thereof, adding Chapter 6.68 to the Municipal Code, to require Police Department permits for extrasensory consultants. Mayor Tarver supported the motion. Ms. Michelotti said this is part she wanted to review. Mayor Tarver said staff has done considerable investigation and work. The reason was because somebody has threatened to sue the City. If the City is successfully sued it will correct the situation. Ms. Michelotti did not want to invite a lawsuit that was nondefendable. She asked if the City is sued and the ordinance does not work, does the City have the chance to come back and make changes. Mr. Roush said yes, but it could cost the City attorney's fees. Ms. Michelotti felt there needed to be a review. The roll call vote was as follows: AYES: Councilmembers - Dennis, Michelotti, Pico and Mayor Tarver. NOES: Councilmember Ayala.
