Mr. Roush said by adding Chapter 6.68, it is more onerous to locate here than what is <br />currently in effect, but some of the concerns raised tonight might be addressed through the <br />permitting process. <br /> <br /> Ms. Michelotti asked what would be better, a permitted use or a conditional use permit? <br /> <br /> Mr. Roush said the courts typically express concern about impacts to First Amendment <br />activity where there is a conditional use permit process. Therefore, a permitted use is less <br />susceptible to a successful legal challenge. <br /> <br /> Ms. Dennis asked if areas could be described where this type of business would be a <br />permitted use, even within an area where it is a currently a conditional use. <br /> <br /> Mr. Pico felt the proposed ordinance was doing that. <br /> <br /> Mr. Roush said it could be more limited. <br /> <br /> Ms. Dennis felt it was important to look at the permitting process. Currently, there is <br />no way to know how this business practices and whether there have been any complaints. She <br />asked about the practitioners associated with bonafide churches. She wanted to know what was <br />a bonafide church. <br /> <br /> Ms. Seto said it is a church that is operating as a non-profit organization. But there is <br />no level of investigation. <br /> <br /> Ms. Dennis did not want to get involved in choosing between the beliefs of the Council. <br />She would just like the business investigated to see if it had done harm to anyone in the past and <br />she had a concern with people being fed potions. <br /> <br /> Mayor Tarver did not feel comfortable in leaving the ordinance the way it is and adopting <br />a permitting process that makes the ordinance more onerous. If Council wanted to regulate <br />practices it needed to look at the process that could be implemented to not make it conditional, <br />but permitted, in industrial areas. <br /> <br /> Ms. Dennis agreed. She felt the City could look at the opportunities for appropriate <br />locations plus a permitting process. <br /> <br /> Ms. Michelotti asked if the IP area included only office use or is there the availability <br />for this business to go into a retail type center. <br /> <br /> Mr. Swift said in the Hacienda. Business Park, the IP uses are allowed in the IPD or <br />IPUD zones.
