Ms. Michelotti said Council still has the right to execute its own discretion as to the
amenity package on a project by project basis. This means that everything that comes before
Council does not have to be done in dollars and cents. There have been projects obtained
through amenities that are within the scope of the project.

Mr. Swift agreed.

Ms. Dennis understood this project was discussed at the Planning Commission, with input
from the community, about the amount of the amenity and what would be provided.

Mr. Swift said there were discussion from the public as well as from the Commission
itself as to what type of amenity this project could provide.

Mr. Pico said the amount of the amenity that is set is not based upon any specific
formula, but is a subjective amount determined by staff and the developer. Council can change
this amount if it wants to.

Ms. Ayala understood the amount was increased by the Planning Commission.

Mr. Swift said that is correct. Council needs to decide what amenity is necessary for
those additional units and that can be whatever the Council determines.

Ms. Michelotti said the determination as to what the money will go towards will be
decided in the future.

Mr. Swift said Council needs to identify the amenity. If the amenity is dollars it can be
decided at a later date where to use the dollars.

Ms. Michelotti asked if the Alviso Adobe was reviewed as part of the project.

Mr. Swift said yes.

It was moved by Ms. Michelotti, and seconded by Ms. Dennis, that Ordinance No.
1769 be introduced, to be read by title only and waiving further reading thereof, approving
PUD-96-14, the application of The DeSilva Group subject to the conditions listed in Exhibit
B and adding condition Option 3 of staff's recommendation; and determining that the
project is to be considered with the first-come, first-served projects for purposes of a
growth management allocation.

Mr. Pico said staff's recommendation has items A through I and Council has not
addressed issues regarding the masonry wall, whether lot H should be eliminated, whether lots
89 and 80 should be combined, etc.

Pleasanton City Council 13 12/01/98
Minutes
