6. PUBLIC HEARINGS AND OTHER MATTERS <br /> <br />Item 6a <br />PUD-98-01, Equus Heights - Dong Yu Real Estate Development <br />Application for PUD development plan approval for a six-lot custom home development <br />located on the west side of Foothill Road at Equus Court. This development plan consists <br />of a portion of a previously approved plan for this site (PUD-87-19, Yee). The 7.68 acre <br />project site is zoned PUD-LDR/RDR/OS (Planned Unit Development - Low Density_ <br />Residential/Rural Density Residential/Open Space) District. (SR98:89) <br /> <br /> Also consider the negative declaration prepared for this project. <br /> <br /> Councilmember Pico abstained from this item and left the dias. <br /> <br /> Brian Swift presented the staff report. <br /> <br /> Mayor Tarver declared the public hearing open. <br /> <br /> There being no speakers the public hearing was closed. <br /> <br /> Mayor Tarver said this development was approved nine years ago and has not been <br /> developed. He felt that if this project had been developed, there would be a major problem in <br /> completing Foothill Road and in developing the infill projects that remain. He said if this <br /> modification is not approved the Merritt property across the street and the property next to it <br /> will not be able to develop. He did not understand why developments are approved and then <br /> sit around for years before they are developed. He said that is what planning is all about and <br /> why the City should be doing an east side study that included all the properties. He also felt the <br /> Foothill Road corridor guidelines should have been done before this project was approved. The <br /> same thing happens over and over again, projects are approved without the knowledge of how <br /> roadways will be developed. It is not fight. The problems should be fixed right. He wanted <br /> the public to understand where he was coming from. <br /> <br /> Ms. Michelotti said sometimes Council does not have any control over the timing of <br /> things, such as the Foothill Overlay Districts, and some projects have been approved before that <br /> District came into being. She said the time has been shortened in regards to how long a project <br /> can stay on the books unless it is developed. She felt it is not always black and white. She <br /> believed this modification is for the better and a step in the right direction. <br /> <br /> Ms. Dennis said she heard from a resident on Fernwood Drive who thought this was a <br /> positive modification.
