Item 6d <br />RZ-97-01, City of Pleasanton <br />Application to mend the Pleasanton Municipal Code to establish requirements for personal <br />wireless service facilities throughout the City. The proposed Municipal Code changes would <br />establish a minimum setback between personal wireless service facilities and the following <br />land uses: residences in Residential and Agricultural Districts, parks, public schools, <br />private schools, nursery_ schools, child care centers, senior care facilities, and nursing <br />homes. The proposed Municipal Code changes would also establish design, location, and <br />processing standards for existing and proposed personal wireless service facilities. <br />(SR98: 93) <br /> <br /> Brian Swift presented the staff report. <br /> <br /> Ms. Acosta suggested if Council is interested in making changes to the ordinance that <br />staff could support not to introduce those changes tonight but rather give the Committee an <br />opportunity to review them. <br /> <br /> Mayor Tarver asked how many meetings did the Wireless Committee hold? <br /> <br /> Mr. Swift said five. <br /> <br /> Mr. Pico asked if the members of committee and the audience had received copies of the <br />ordinance. <br /> <br /> Mr. Swift said yes. <br /> <br /> Mayor Tarver declared the public hearing open. <br /> <br /> Mark Smith, 4241 Cabernet Court, said the staff performed wonderfully and he was <br />pleased to reach an agreement. He supported the ordinance as written. <br /> <br /> Mary Smith, 4241 Cabernet Court, was pleased to serve on the Committee and supported <br />what the committee is recommending. She does not want the antennas on school property or <br />in public parks. <br /> <br /> Ms. Ayala said it would be helpful if she were to attend a school board meeting and ask <br />for a letter of support. <br /> <br /> Peggy O'Laughlin, 1740 Technology Drive, Suite 250, San Jose, attorney for GTE <br />Wireless, said GTE can and does support the wireless ordinance as recommended by the <br />Planning Commission, but GTE cannot support the ordinance that is before Council tonight. <br />The primary reason GTE cannot support the ordinance tonight is because of the siting <br />restrictions listed in the ordinance. The 300 foot buffer is in violation of the Federal <br />Telecommunications Act. Section 704 of the Act states no state or local government may <br />regulate the placement, construction and modification of wireless service facilities on the basis <br />of environmental effects of radio frequency emissions to the extent that those facilities comply <br /> <br />Pleasanton City Council 11 4/21/98 <br />Minutes <br /> <br /> <br />
