Mayor Tarver said with the Greenbriar's development, the infrastructure has to be in
place before the final map can be recorded.

Mr. Swift said Greenbriar will record a final map and enter into an improvement
agreement with the city to build all the infrastructure necessary for its development. The Frost
property cannot do that because it is too small.

Ms. Ayala asked, with the Mayor's motion, would the infrastructure costs have to be
estimated?

Mr. Swift said yes, if the final map was ready to record prior to the time Greenbriar was
ready to develop.

Ms. Michelotti asked if the Frosts would have to pay fees with the final map?

Mr. Swift said that is what the specific plan requires and that is what the conditions are.
The fees would be estimated rather than actual costs.

Mr. Roush asked if it would be for the frontage along the Frosts' property?

Mr. Swift said the property owners would pay their pro rata share of all the North
Sycamore improvement costs.

Ms. Michelotti understood that if the individual who would bring forth the application
proceeded with the tentative map and final map, the fees would have to be paid for up front.
But if the property owner had a vested tentative map and in the process sold the property and
someone else applied for a final map, the fees would be delayed.

Mr. Swift said that is correct, until the time of the final map.

It was moved by Ms. Ayala, seconded by Mr. Pico, that Ordinance No. 1742 be
introduced, to be read by title only and waiving further reading thereof, approving the
application of Mike and Susan Frost for PUD plan approval as filed under Case PUD-97-
21, with an amendment to Condition 5 to provide that the PUD plan will lapse after two
years after installation of infrastructure unless a final map is recorded.

Mayor Tarver did not see a problem with staff's recommendation, he felt it would all be
done. He disagreed with the two year extension. He felt the smaller projects should be treated
the same as the larger projects.

Pleasanton City Council 4/7/98
Minutes

14
