Mayor Tarver said with the Greenbriar's development, the infrastructure has to be in <br />place before the final map can be recorded. <br /> <br /> Mr. Swift said Greenbriar will record a final map and enter into an improvement <br />agreement with the city to build all the infrastructure necessary for its development. The Frost <br />property cannot do that because it is too small. <br /> <br /> Ms. Ayala asked, with the Mayor's motion, would the infrastructure costs have to be <br />estimated? <br /> <br /> Mr. Swift said yes, if the final map was ready to record prior to the time Greenbriar was <br />ready to develop. <br /> <br /> Ms. Michelotti asked if the Frosts would have to pay fees with the final map? <br /> <br /> Mr. Swift said that is what the specific plan requires and that is what the conditions are. <br />The fees would be estimated rather than actual costs. <br /> <br /> Mr. Roush asked if it would be for the frontage along the Frosts' property? <br /> <br /> Mr. Swift said the property owners would pay their pro rata share of all the North <br />Sycamore improvement costs. <br /> <br /> Ms. Michelotti understood that if the individual who would bring forth the application <br />proceeded with the tentative map and final map, the fees would have to be paid for up front. <br />But if the property owner had a vested tentative map and in the process sold the property and <br />someone else applied for a final map, the fees would be delayed. <br /> <br /> Mr. Swift said that is correct, until the time of the final map. <br /> <br /> It was moved by Ms. Ayala, seconded by Mr. Pico, that Ordinance No. 1742 be <br />introduced, to be read by title only and waiving further reading thereof, approving the <br />application of Mike and Susan Frost for PUD plan approval as filed under Case PUD-97- <br />21, with an amendment to Condition 5 to provide that the PUD plan will lapse after two <br />years after installation of infrastructure unless a final map is recorded. <br /> <br /> Mayor Tarver did not see a problem with staff's recommendation, he felt it would all be <br />done. He disagreed with the two year extension.
