Mr. Swift said there are a number of other smaller properties that would be in the same <br />situation depending upon when Greenbriar constructs most of the infrastructure. <br /> <br /> Ms. Dennis asked if infrastructure issues would be resolved before the final maps were <br />approved. <br /> <br /> Mr. Swift said normally when the tentative map is granted it shows the proposed <br />infrastructure for the project and at the time the final map is recorded, the developer would enter <br />into an improvement agreement and bond for the extensions of the utilities, roads, water <br />systems, etc., that would be necessary to provide the infrastructure to the property. In the <br />Frost's case, the infrastructure costs outweigh the cost of the property. <br /> <br /> Ms. Dennis asked if the infrastructure could wait until other projects had started? <br /> <br /> Mr. Swift said the east/west connector street would need to be built in order to have <br />access to parcel three, the water tank had to be built in order to provide water at the right <br />pressure for the parcels, and the sewer line needed to be constructed. The cost for these <br />infrastructures is fairly expensive. It is anticipated that this infrastructure would be built by <br />either Greenbriar or by New Cities Development. Greenbriar would install the water, sewer and <br />construct the east/west collector road. <br /> <br /> Ms. Michelotti asked if the three parcels would legally have a right to the infrastructures? <br /> <br /> Mr. Swift said if a vesting tentative map for the three parcels is granted then no <br />subsequent action by the city to rezone the property would undo the subdivision. The tentative <br />map could lapse after a certain amount of time (three years), but it is expected the Greenbriar <br />property would be developed by then. Staff believes if the property owners proceed to get a <br />vesting tentative map, they would have the assurance that they could get a final map in a <br />reasonable time frame. <br /> <br /> Ms. Ayala asked if the cost for the infrastructure was underestimated, where will the <br />money come from to finish the infrastructure? <br /> <br /> Mr. Swift said it would be possible to write in a condition that if the costs were higher <br />than anticipated, the money would come from the existing property owners. The problem with <br />that approval is it could be three separate property owners.
