Her interpretation of the ordinance is that performance standards are being looked at. <br />She did not believe there was a problem with high performance firearms being included on the <br />list, because if they were, they would be appealed off successfully. <br /> <br /> Mr. Pico did not feel comfortable adopting an ordinance that was technically flawed. <br /> <br /> Ms. Michelotti felt the community wanted something that addressed firearms. She said <br />she has done the best job she can to logically address this issue. Her objective from the <br />beginning was to have an ordinance that was the very best. <br /> <br /> It was moved by Ms. Dennis, seconded by Ms. Ayala, to adopt Ordinance 1719, <br />providing for the regulation of firearm sales through a permitting process and prohibiting <br />the sale of "Saturday Night Specials" by amending Title 6 and Title 20 of the Pleasanton <br />Municipal Code. <br /> <br /> Ms. Ayala asked the City Attorney if he believed the ordinance was technically flawed? <br /> <br /> Mr. Roush said a similar ordinance had been challenged. To this point the ordinance had <br />been upheld. At this point there is no court that says the ordinance is legally or technically <br />flawed. <br /> <br /> Ms. Michelotti said she would like something written in the ordinance regarding the <br />performance standards. <br /> <br /> Mayor Tarver felt the ordinance needed to go to the vote of the people and on that basis, <br />he could not support the ordinance. <br /> <br /> Ms. Ayala said the people were ready to go through the referendum process. <br /> <br /> Mayor Tarver said the people felt they were fighting the government.
