Mr. Roush said home occupation businesses are only investigated if a complaint is filed.
A non-exempt home occupation permit could be done which would allow customers and some
inventory. If there was a non-exempt home occupation permit it would have to go through a
conditional use permit process and at that point the neighborhood would be notified and a
hearing would be held. The fundamental issue is whether there should be firearm sales in a
residential neighborhood.

Ms. Michelotti had a concern with the existing firearm dealers having one year to
relocate.

Mr. Pico said he could accept the zoning ordinance.

The roll call vote was as follows:
AYES: Councilmembers- Ayala, Dennis, Michelotti, and Pico.
NOES: Mayor Tarver
ABSENT: None
ABSTAIN: None

It was moved by Mr. Pico, and seconded by Mayor Tarver, to submit Ordinance
1719 to the voters as a Council sponsored initiative.

Mr. Pico said what he heard tonight did not support the ordinance.

Ms. Ayala believed there was not enough people that wanted this on the ballot. She
mentioned the referendum process.

Mr. Pico did not want to split the community. He felt this was a very controversial issue
that should be voted on by the people.

Ms. Dennis did not want to impose an election on the people. If the community wanted
to go through the election process, they would sign the petitions.

The roll call vote was as follows:
AYES: Councilmember Pico and Mayor Tarver.
NOES: Councilmembers Ayala, Dennis, and Michelotti.
ABSENT: None
ABSTAIN: None

5. CLOSED SESSION

Council adjourned to Closed Session at 11:50 p.m. to confer with legal counsel regarding
the pending workers' compensation claim of Donald Bubeck.

Pleasanton City Council 21 02/09/98
Minutes
