It was moved by Ms. Dennis, and seconded by Ms. Ayala, to reintroduce Ordinance
1719, to be read by title only and waiving further reading thereof, prohibiting the sale of
"Saturday Night Specials" by amending Title 6 and Title 20 of the Pleasanton Municipal
Code.

Mayor Tarver reiterated that he supported the ordinance but still felt the issue should go
to the people for a vote.

The roll call vote was as follows:
AYES: Councilmembers - Ayala, Dennis, and Michelotti.
NOES: Councilmember Pico and Mayor Tarver.
ABSENT: None
ABSTAIN: None

It was moved by Ms. Dennis, and seconded by Ms. Ayala, that Ordinance No. 1738
be introduced, to be read by title only and waiving further reading thereof, amending
Chapters 18.08 (Definitions), 18.28 (Agriculture District), 18.32 (One-Family Residential
Districts), 18.36 (Multi-family Residential Districts), 18.40 (Office District), 18.44
(Commercial Districts), 18.48 (Industrial Districts), 18.52 (Rock, Sand and Gravel
Extraction District), 18.56 (Public and Institutional Distric0 and 18.104 (Home
Occupations) of the Pleasanton Municipal Code to add regulations for firearm sales, to
change the regulations for gunsmiths, and to change the minimum office space regulations
for office uses in the industrial park district.

Ms. Michelotti asked Mr. Pico if he would support the zoning ordinance.

Mr. Pico said there are individuals saying they have signed an exempt home occupation
form. If someone is truly selling out of a catalog, then they would be complying with the
exempt home occupation certificate. He did not see this being any different than someone
selling vitamins out of a catalog. If someone was violating the home occupation permit then it
could be looked at. If a gun dealer was just a transfer station and complied with an exempt
home occupation permit, the dealer should be left alone.

Ms. Michelotti asked if a conditional use permit process was attached to the ordinance
for residential dealers, would he support it?

Mr. Pico said yes.

Ms. Ayala asked who regulated the home dealers?

Pleasanton City Council 20 02/09/98
Minutes
