issues, in which the Council is actively involved in, and when brought to closure a public <br />hearing will be held. <br /> <br /> Mayor Tarver said he did review the minutes from the Zone 7 meeting and the summary <br />that is provided is fairly accurate in terms of what he said. He told the Zone 7 Board that he <br />believed the Board had the power to do an initiative and that the City's City Attorney disagrees <br />with the County's Counsel about what the scope of the initiative should be, and that he was <br />imploring them to make a democratic decision, which is to put the issue on the ballot and let the <br />people vote on it who are directly affected. He said the Board refuses to make that commitment. <br />The City of Pleasanton's Council has consistently taken the position of putting this to the vote <br />of the residents. He said he would get him a copy of the letter sent by Scott Haggerty. He said <br />the residents in Fremont, Hayward, Berkeley and Oakland are not going to be affected by the <br />decision of Zone 7. If and when the Sierra Club submits its initiative and the County Counsel <br />makes a determination as to the fact it has to be a County-wide initiative, he would represent <br />the residents of Pleasanton by suggesting that the County be challenged regarding its <br />determination. <br /> <br /> Mr. C0rdtz said Zone 7 thinks $20 million is a great sum of money to give the rate <br />payers, but ~t is not. He said 10,000 homes at $400,000 with a 6% commission interest is mind <br />boggling, but not $20 million. <br /> <br /> Geoff Cooper, 7534 Flagstone, said the Planning Commission after hearing evidence <br />presented as a resolution, not attached as a condition, but a recommendation, that a temporary <br />closure be considered, i.e. agendized. At the time the Counsel did not indicate anything was <br />wrong with this and yet tonight the Council is opposed to this idea without hearing any evidence <br />at all. He was wondering if the Counsel could comment on the proprietary of the statements <br />made. He said the Planning Commission heard the evidence, a separate resolution was <br />submitted that is non-binding, advisory only and recommended that a public hearing be held. <br />He said on another similar matter, the Alameda Commuter Express, the Planning Commission <br />asked that the closure of West Angela be agendized. The Planning Commission is still waiting <br />for staff to let the Planning Commission discuss a potential closure of West Angela in relation <br />to safety issues around the ACE station. He asked what would it take to get these items <br />agendized. He thought it was inappropriate for the Council to pass judgment without a hearing. <br />He said the Council has not heard any evidence or no public discussion has been held. He said <br />the Planning Commission heard the evidence and submitted a resolution that is non-binding <br />(advisory only) recommending there be a public hearing held. On another matter, the Altamont <br />Commuter Express, the Planning Commission asked that the closure of West Angela be <br />agenized. The Planning Commission is still waiting for this to be heard. He felt it was <br />inappropriate for Council to pass judgement before hearing the facts.
