Mr. Swift said the trash receptacles that they have built in would meet the requirement
of the condition. The question is whether or not there needed to be a trash receptacle at the
store entrance.

Ms. Dennis wanted a trash receptacle at the front entrance.

Mayor Tarver made a motion to approve according to staff's recommendations with the
condition that the sale of alcoholic beverages be eliminated; remove Condition No. 12, the
exterior window and to remove Condition No. 19, with the exception that a trash receptacle be
installed at the front entrance and leave in Condition No. 36.

Ms. Dennis did not feel the limited sale of alcohol was a problem.

Mayor Tarver would not support a motion allowing the sale of alcohol because he felt
alcohol and gasoline do not mix.

It was moved by Ms. Dennis, and seconded by Ms. Ayala, to adopt Resolution No.
98-121, approving a negative declaration for the application of Chevron Products Company,
Inc., as filed under case PUD-97-14 and UP-97-70.
The roll call vote was as follows:
AYES: Councilmembers - Ayala, Dennis, and Michelotti.
NOES: Mayor Tarver
ABSENT: Councilmember Pico
ABSTAIN: None

It was moved by Ms. Dennis, and seconded by Ms. Ayala, that Ordinance No. 1760
be introduced, to be read by title only and waiving further reading thereof, approving the
application of Chevron Products Company, Inc. for planned unit development rezoning and
development plan approval as filed under Case PUD-97-14; except eliminating Condition
No. 12 (the exterior window) and the trash receptacles at the islands.
The roll call vote was as follows:
AYES: Councilmembers - Ayala, Dennis, and Michelotti.
NOES: Mayor Tarver
ABSENT: Councilmember Pico
ABSTAIN: None

7.
