(SR98: 197)

Item 6a(2)
Consideration of placing on the November 1998 Ballot whether (1) to eliminate the City
Treasurer as an elected position, (2) the term for Mayor should be four rather than two
years and (3) vacancies for council positions should be filled by an election rather than by
appointment. (SR98: 191)

Randall Lum presented the staff report for Item 6a(1).

Ms. Michelotti asked if the ballot language states what we want to do; that is, if it is not
possible to reline the pipeline, can we go forward with a single pipeline? She had no problem
with everything coming back to a vote, but wanted to keep this simple yet allow LAVWMA to
do what was necessary.

Mayor Tarver believed that this wording provides flexibility for the agreements made
under the Principles of Agreement. That referred to dry weather flow, service area, and export
pipeline capacity. Those are the fundamental principles that are the basis of the agreement.
This wording provides for the possibility for the LAVWMA Board to come up with another
alternative as long as the principles are adhered to.

Mr. Lum said that was correct. So long as export capacity or the area served is not
increased, the change to a single pipeline could occur without submitting the matter to the
voters; however it would require unanimous agreement among the members of the Agency.

Mayor Tarver explained that Livermore believes this wording protects against expansion
beyond what has been planned for in the General Plans of the cities.

Pleasanton City Council 5 07/21/98
Minutes
