Mr. Pico said the proposal to widen Ray Street did not provide any significant <br /> improvement and in fact it created additional constrictions. <br /> <br /> It was moved by Mr. Hco, and seconded by Ms. Ayala, to adopt Resolution No. <br />98-99, upholding the appeal for the application of Diane and Edward Churka (Coffee Roast <br />Express) for design review approval, as filed under Case Z-98-145 (AP-98-04) and to modify <br />the in-lieu parking agreement. <br /> <br /> Mayor Tarver reiterated his concerns with the in-lieu fee process. <br /> <br /> Mr. Roush said Council could give direction that the agreement provide a different area <br />of benefit, and the time to pay to be earlier than the parking lot was established. Staff would <br />need this direction tonight. <br /> <br /> Ms. Michelotti felt there needed to be specification regarding the benefit area. <br /> <br /> Mr. Pico felt an area did not need to be specified tonight. <br /> <br /> Mr. Roush said currently the agreement provides that the in-lieu payment does not start <br />until the City has identified a particular area. If Council would like more flexibility, to have <br />the payments start earlier, then that would need to be provided in the agreement. <br /> <br /> Mr. Pico was not interested in accelerating the payments. <br /> <br /> Ms. Michelotti asked if it was possible to split the application and the approval of the <br />expanded square feet from the motion. <br /> <br /> Mayor Tarver said staff is going to work with the applicant to clarify what it is he is <br />asking for and then apply the in-lieu parking fees standard. <br /> <br /> Ms. Michelotti was in support of looking at how in-lieu fees are being collected. <br /> <br /> Mayor Tarver felt it was not necessary to amend the motion if the Pleasanton Downtown <br />Association and the City of Pleasanton work together to identify parking areas in the downtown <br />area. As soon as this happens, then the in-lieu fee can be collected. <br /> <br /> Ms. Dennis made a substitute motion to include that the benefit area may be larger <br />and that the in-lieu payment may be due at the time when a decision is made on a site for <br />the parking lot. <br /> <br /> Ms. Ayala said the substitute motion is changing that the parking lot does not have to be <br />built before the fee would be collected. <br /> <br />Pleasanton City Council 22 07/07/98 <br />Minutes <br /> <br /> <br />
