construction of the Bernal Avenue Extension within the Road Easement as is shown <br />on "Plan 5" attached hereto as Exhibit "D," and in connection therewith. the <br />construction of E. Angela Street within the Street Easement as a usable two-lane <br />street. City shall be responsible for assudng that said construction work shall be <br />contracted for, performed, and supervised by competent personnel. <br /> <br /> (1) City shall incorporate into the plans for the roadwork and shall install <br />slope stabilization landscaping along the Bernal Avenue extension in the areas of <br />the Slope Easement. <br /> <br /> (2) Dudng the construction of said roadwork, City shall construct or cause to <br />be constructed, a fence along the southeasterly side of the Bernal Avenue extension <br />suitable to contain horses which graze on the southeasterly portion of the Subject <br />Property. The fence shall include a gateway sufficent to permit a truck traffic into the <br />southeasterly portion of the Subject Property. City shall be responsible to assure the <br />integrity of the fenceline dudng the construction of the Bemal Avenue extension. <br /> <br /> B. Reimbursement for pro rata Construction Costs. <br /> <br />Upon the recordation of the first Final Map allowing for the development of the <br />Subject Property pursuant to the plans processed by Centaur and Shapell, the <br />developer shall reimburse City the sum of Three Hundred Seventy Four Thousand <br />Dollars ($374,000.00) as its proportionate share of the construction costs of the <br />Bemal Avenue Extension and, in addition, shall reimburse City in the actual amount <br />of the construction costs for the E. Angela Street extension. Bonde, or successor, <br />shall be entitled to review and approve the constructions costs of said road work. <br /> <br /> C. Mutual Temporary Construction Access. <br /> <br /> (1) Bonde hereby grants a temporary construction access easement <br />("Construction Access Easement") over a portion of the Subject Property for use by <br />City and its contractors dudng the construction of the Bernal Avenue Extension. The <br />easement shall be deemed effective at the commencement of construction of the <br />Bernal Avenue Extension and E. Angela Street, and shall terminate upon the <br />completion of said construction. A copy of the Construction Access Easement <br />showing the location of the easement is attached hereto as Exhibit "E." <br /> <br /> - 3 - <br /> <br /> <br />
