for the extension of Bernal Avenue through the Subject Property. Now Therefore, the parties have agreed as follows: Provisions 1o D_.~- Bonde hereby dedicates to City the easements and right of ways identified below. Centaur and Shapell hereby consent to the identified dedications and further agree that any dghts they may otherwise have to acquire title to the Subject Property by virtue of the Purchase Agreement and the Joint Development Agreement shall be subject to said dedications. The parties each acknowledge that the dedications are given in lieu of condemnation of said rights of way and easements and in consideration of the additional promises of the parties contained herein. The parties agree to execute and acknowledge such documents as may be required to further effect the dedications described herein. A. Right of Way and Slope Easements. Dedication of a seventy (70') foot wide right of way for the Bernal Avenue extension ("Road Easement") along with the necessary slope easements ("Slope Easement") required by the topography of the Road Easement. The dedication of the Road Easement and the Slope Easement are attached hereto as Exhibit "B." B. E. Angela Street Right of Way. Dedication of a right of way for proposed public street, E. Angela Street. ("Street Easement"). A copy of the Street Easement is attached hereto as Exhibit "C." C. Other Easements. Dedication of such other temporary or permanant easements as are reasonably necessary to accomplish the purpose of this agreement. 2. A~¢eDtance of Dedications. City hereby accepts the dedications of the Road Easement, the Slope Easement, the Street Easement into the City public street system. 3. Construction of Bernal Avenue and E. Anqela Street Extension.
