CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 88-54 RESOLUTION DENYING THE APPEAL AND UPHOLDING THE BOARD OF ADJUSTMENT APPROVAL OF THE APPLICATION OF EXXON CORPORATION FOR A VARIANCE REGARDING THE SIGNING PROGRAM AT 3192 SANTA RITA ROAD (AP-SS-02/V-87-30) WHEREAS, Exxon Corporation applied for approval of a variance from the Municipal Code to permit the installation of a second free-standing sign where one such sign is permitted and to allow for a comprehensive signing program to exceed the maximum sign area permitted for a service station use to be located at 3192 Santa Rita Road (V-87-30); and WHEREAS, the Board of Adjustment approved the application on January 13, 1988 with various conditions; and WHEREAS, this decision was appealed by the City Council so they could review the application totally; and WHEREAS, a duly noticed public hearing was held before the City Council on February 2, 1988 at which time all pertinent testimony and documents were reviewed; and WHEREAS, after a review of the material presented, the City Council makes the following findings: a. That special circumstances unique to the site can be found. Other service stations have been granted variances for more than one freestanding sign. b. That the proposal will not constitute a grant of special privilege. Because other service stations have been granted variances for more than one freestanding sign, approval will not constitute a grant of special privilege. c. That the health, safety and general welfare of the surrounding area are not jeopardized by the request. The proposed program, if built to all applicable codes, would not affect the health, safety or general welfare of the surrounding area; and
