CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-54 <br /> <br /> RESOLUTION DENYING THE APPEAL AND UPHOLDING THE BOARD OF <br /> ADJUSTMENT APPROVAL OF THE APPLICATION OF EXXON <br /> CORPORATION FOR A VARIANCE REGARDING THE SIGNING PROGRAM <br /> AT 3192 SANTA RITA ROAD (AP-SS-02/V-87-30) <br /> <br />WHEREAS, Exxon Corporation applied for approval of a variance <br /> from the Municipal Code to permit the installation of a <br /> second free-standing sign where one such sign is <br /> permitted and to allow for a comprehensive signing <br /> program to exceed the maximum sign area permitted for a <br /> service station use to be located at 3192 Santa Rita <br /> Road (V-87-30); and <br /> <br />WHEREAS, the Board of Adjustment approved the application on <br /> January 13, 1988 with various conditions; and <br /> <br />WHEREAS, this decision was appealed by the City Council so they <br /> could review the application totally; and <br /> <br />WHEREAS, a duly noticed public hearing was held before the City <br /> Council on February 2, 1988 at which time all pertinent <br /> testimony and documents were reviewed; and <br /> <br />WHEREAS, after a review of the material presented, the City <br /> Council makes the following findings: <br /> <br /> a. That special circumstances unique to the site can <br /> be found. <br /> <br /> Other service stations have been granted variances <br /> for more than one freestanding sign. <br /> <br /> b. That the proposal will not constitute a grant of <br /> special privilege. <br /> <br /> Because other service stations have been granted <br /> variances for more than one freestanding sign, <br /> approval will not constitute a grant of special <br /> privilege. <br /> <br /> c. That the health, safety and general welfare of the <br /> surrounding area are not jeopardized by the <br /> request. <br /> <br /> The proposed program, if built to all applicable <br /> codes, would not affect the health, safety or <br /> general welfare of the surrounding area; and <br /> <br /> <br />
