Resolution No. 88-284
Page Two

to offset the cumulative cost of capital facilities
made necessary by ongoing residential development.

Section 4: Effect of Approval

a. The effect of these growth management
approvals shall be to authorize development,
building and occupancy of the approved units
and provide for the lapsing of approvals in
accordance with Chapter 17.36 of the
Pleasanton Municipal Code as worded on the
effective date of Ordinance 1336 (attached
hereto) and the additional conditions spelled
out in this resolution.

b. The City grants these growth management
approvals with the expectation and
understanding that the owners of lands upon
which approval is granted will rely upon their
continuing validity. However, the City cannot
guarantee that actions beyond reasonable
control of the City will not interfere with
development of the subject parcels.

c. The City will use its best efforts to reserve
sewage capacity sufficient for outstanding
valid sewer permits, but this resolution does
not guarantee the availability of sufficient
sewage treatment capacity to serve the
project. Building permits may be withheld if
sewage treatment capacity is determined by the
City, the Dublin San Ramon Services District
or The Regional Water Quality Control Board
not to be available at the time developer
applies for a building permit. In the event
sewage treatment capacity is not available to
enable developer to meet the development
schedule approved by the resolution, the City
will enact amendments to this resolution which
will, as so far as is feasible, carry out the
intent of this resolution given the
availability of sewage treatment capacity.

Section 5: Nothing herein shall lessen any obligation of
developer required as a condition of any other
approvals granted by the City.

Section 6: This resolution shall become effective
immediately upon its passage and adoption.
