CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-206 <br /> <br /> ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 87-26 <br /> <br />WHEREAS, by Resolution No. 88-172, a public hearing was called <br /> for May 3, 1988, at the hour of 8:00 p.m. in the Council <br /> Chambers, Pleasanton, California, to ascertain whether <br /> the public necessity, health, safety, or welfare <br /> requires the removal of poles, overhead wires and <br /> associated overhead structures, and the underground <br /> installation of wires and facilities for supplying <br /> electric communication, or similar or associated <br /> service, within that certain area of the City descried <br /> as Spring Street, Railroad Avenue and Division Street <br /> from Main Street to Railroad Avenue, UUD 87-26; and <br /> <br />WHEREAS, notice of such hearing has been given to all affected <br /> property owners as shown on the last equalized <br /> assessment roll and utilities concerned in the manner <br /> and for the time required by law; and <br /> <br />WHEREAS, such hearing has been duly and regularly held, and all <br /> persons interested have been given an opportunity to be <br /> heard; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: City Council hereby finds and determines that the <br /> public necessity, health, safety, and welfare required <br /> the removal of poles, overhead wires and associated <br /> structures, and the underground installation of wires <br /> and facilities for supplying electric, communication, or <br /> similar or associated service on both sides of Spring <br /> Street, Railroad Avenue and Division Street from Main <br /> Street to Railroad Avenue, such described are is hereby <br /> established as Underground Utility District No. 87-26. <br /> Attached hereto, marked "Exhibit A," and hereby <br /> incorporated as part of this resolution, is a map <br /> delineating the boundaries of said District. <br /> <br />Section 2: That the City Council hereby makes the following <br /> further findings with regard to Underground Utility <br /> District No. 87-26: <br /> <br /> 1. The undergrounding to be accomplished pursuant to <br /> this resolution will avoid or eliminate an <br /> unusually heavy concentration of overhead <br /> distribution facilities. <br /> <br /> <br />
