ARTICLE VII--Contractor shall complete the work in a period of <br />one hundred forty-five (145) calendar days following receipt of <br />the Owner's Notice to Proceed. Should the Contractor fail to <br />complete the work, or any part thereof, within the stipulated <br />period, or within such extra time as may have been allowed by <br />extensions granted as provided in the Contract, the Contractor <br />shall reimburse the Owner at one hundred dollars ($100) per <br />calendar day that the Contract remains uncompleted after the <br />Contract completion date. This amount is not to be considered in <br />the nature of a penalty, but as liquidated damages which have <br />been accrued against the Contractor for the loss to the Owner on <br />account of expense due to the employment of Engineers, <br />inspectors, and other employees after the expiration of the time <br />of completion, and on account of the value of the operation of <br />the works dependent thereon. The Owner shall have the right to <br />deduct such damages from any amount due, or that may become due <br />the Contractor, or the amount of such damages shall be due and <br />collectible from the Contractor or his Surety. <br /> <br />ARTICLE VIII--Contractor further agrees to fulfill the following: <br /> <br />A. Contractor shall indemnify save and hold harmless from and <br /> defend the City, members of the City Council and their <br /> agents, consultants, architects, servants and employees, <br /> against any and all claims, costs, demands, causes of action, <br /> suits, losses, expense or other detriment or liability <br /> arising from or out of acts or omissions of Contractor, its <br /> agents, subcontractors, officials or employees, in connection <br /> with the execution of the work covered by this contract or <br /> any amendment thereto. <br /> <br />B. Provide a Certificate of Insurance issued to the City of <br /> Pleasanton from his insurance carrier providing proof of <br /> Workers's Compensation and Policy Number. <br /> <br />C. Provide a Certificate of Insurance from his insurance carrier <br /> showing the amount of Public Liability and Property Damage <br /> coverage and naming the City of Pleasanton, its officers, <br /> employees, and Agents as additionally insured. Insurance <br /> coverage shall be in at least the following amounts: <br /> <br /> PUBLIC LIABILITY <br /> General Bodily Injury - $1,000,000 Per Occurrence <br /> General Property Damage - $ 500,000 Per Occurrence <br /> OR <br /> Combined Single Limit of Bodily Injury and Property Damage <br /> Liability - $1,000,000 <br /> <br /> AUTOMOBILE LIABILITY <br /> Bodily Injury - $ 500,000 Per Person/ <br /> $1,000,000 Per Occurrence <br /> Property Damage - $ 100,000 Per Occurrence <br /> <br /> <br />
