9. You knew nothing of the Nelsons' involvement in drug useage and sales, or <br /> involvement regarding.the premises. <br /> <br />10. You waited more than one year to accept one dollar from Nelson in payment <br /> for the business because you, "wanted to wait to see what happened" (as <br /> far as the court action against Nelson was concerned). <br /> <br />Having considered the issues you brought forth in the mitigation hearing of June <br />29, 1988, alon9 with the totality of circumstances referred to hereafter, Ihave <br />concluded that the only reasonable course of action is for me to revoke your <br />cardroom permit. Conviction of the co-permit holder in a felony drug salesL <br />case coupled with prior license violations as enumerated below is sufficient <br />cause, in itself, for revocation. Additional facts contributing to this <br />decision are as follows: <br /> <br />...Between October 1986 and April 1987 information was received from three' <br /> confidential and reliable informants that Mark Schoffstall, Timothy Graff, <br /> Ricky Gunn, and Cathy Yanez were selling drugs (cocaine) for Jay Nelson. <br /> <br />...On October 14, 1986 Officer Jim Knox purchased marijuana from Timothy Graff <br />inside the Pastime Pool Hall. The transaction took place in plain view. <br /> <br />...On March 12, 1987 a confidential informant purchased cocaine from Mark <br /> Schoffstall, inside the pool hall. Schoffstall received the money in the <br /> licensed premises. He then drove Frank Shenave's (co-licensee) vehicle to <br /> the residence of Jay Nelson. He picked up the drugs at that location and <br /> returned to the Pastime. He gave the informant the cocaine and told him it <br /> came from Jay Nelson. <br /> <br />...On April 6, 1987 another informant purchased cocaine from Cathy Yanez. She <br /> was followed by undercover officers to Jay Nelson's residence. She said she <br /> purchased the cocaine froin Jeanne Nelson at the residence. <br /> <br />...On April 12, 1987 a third informant purchased cocaine from Cathy Yanez. She <br /> said she had purchased the drugs from Jay Nelson. Yanez was followed from <br /> her house after receiving the buy money. She went to the parking lot of the <br /> Pastime. She returned with the drugs and completed the transaction. <br /> <br />...On April 17, 1987 an informant again purchased cocaine from Cathy Yanez. <br /> She phoned Jay Nelson from her house to arrange the transaction. She later <br /> completed the transaction for ½ gram of cocaine. She stated that she <br /> received the cocaine from Jay Nelson. <br /> <br /> ...On April 18, 1987 a search warrant was served on the residence of Jay <br /> Nelson. Methamphetamine, cocaine, cash and drug paraphernalia for use and <br /> sales of drugs were seized. A portion of our "buy money" was seized. <br /> Nelson stated, "A guy has to make a living some way." <br /> <br /> ...On September 15, 1987 the permit holder appeared before the City Council to <br /> oppose an increase in permit fees. The Council approved all other <br /> recommended fee changes and held over the changes affecting the cardroom <br /> pursuant to your request. On October 6, 1987 the Council took action to <br /> adjust the fees as recommended after hearing your objections. You were <br /> advised in public record that the policing costs for special police <br /> investigations had exceeded $7,000 in the past year. You were aware that <br /> Jay Nelson had been arrested and charged in the above referenced drug <br /> investigations. You were aware that the licensed premises was a centerpoint <br /> for this investigation. <br /> <br /> <br />
