I. It is the intent of LIVERMORE, PLEASANTON, and AUTHORITY to <br />cooperate to facilitate the development of the El Charro Specific Plan and <br />Staples Ranch Property. <br />J. It is the intent of all parties to work to secure Zone 7 approval of a cost <br />effective Livermore Flood Protection Improvements project that is eligible for <br />reimbursement and/or exemption credits, to obtain reimbursement for <br />Livermore Flood Protection Improvements required for these developments <br />and to have Zone 7 prioritize these improvements in their StreamWISE <br />program. <br />K. LIVERMORE and PLEASANTON agree to work together to secure Caltrans <br />approval of any additional improvements required for the Caltrans I- <br />580/Fallon Road Interchange Modification Project No. 04-257604. <br />L. All parties wish to enter into a cost sharing agreement for the improvements <br />which are mutually beneficial to LIVERMORE and PLEASANTON and <br />AUTHORITY. <br />NOW, THEREFORE, in consideration of the foregoing and the mutual <br />covenants and obligations set forth in this Agreement, the parties hereby agree as follows: <br />AGREEMENT <br />1. DEFINITIONS: <br />1.1 The "El Charro Road Improvements" are defined as those road improvements <br />within the El Charro Road right-of--way shown in Exhibit _, as well as any related <br />storm water collection, treatment and retention. The El Charro Road Improvements <br />specifically do not include the relocation or replacement of Freisman Road. <br />1.2 The "Freisman Road Relocation Improvements" are defined as those <br />improvements shown on Exhibit <br />1.3 The "Livermore Flood Protection Improvements" are defined as those <br />improvements consisting of and limited to a North Overbank Barrier and South <br />Detention/Conveyance Facility, located within the El Charro Specific Plan Area, <br />necessary to remove the commercial development portions of the El Charro Specific <br />Plan area and the entire Staples Ranch Property from the 100 year flood zone and that <br />are acceptable to Zone 7 and AUTHORITY. The Livermore Flood Protection <br />Improvements may be incorporated as elements of a more comprehensive flood <br />protection improvement project as part of Zone 7's StreamWISE project. <br />3 <br />Cost Sharing Agreement <br />Surplus Property Authority, Livermore and Pleasanton <br />
