WHEREAS, Both the El Charro Specific Plan and the Staples Ranch Project require improvements to <br />El Charro Road prior to occupancy of new developments, and AUTHORITY and <br />LIVERMORE, together with the County of Alameda ("the County"), PLEASANTON <br />and Vulcan Materials, have negotiated and are executing the Pre-Development <br />Cooperation Agreement that specifies the level and timing of construction of the El <br />Charro Road Improvements. <br />WHEREAS, The LIVERMORE EIR indicates that a portion of the El Charro Specific Plan is currently <br />within the 100-year flood zone, and that a portion of the Staples Ranch Property is also <br />within the 100-year flood zone. As described in the Livermore EIR, flood water passes <br />through the El Charro Specific Plan and then crosses El Charro Road just south of <br />Interstate 580. The LIVERMORE EIR also indicates that LIVERMORE has proposed <br />flood protection improvements within the El Charro Specific Plan, including a North <br />Overbank and a South Detention Conveyance Facility ("Livermore Flood Protection <br />Improvements"), which would remove a portion of the El Charro Specific Plan from the <br />100-year flood zone, without impacting downstream development. The Livermore Flood <br />Protection Improvements remove a portion of the developable area of the El Charro <br />Specific Plan from the 100-year flood zone and will also remove all portions of the <br />Staples Ranch Property from the 100-year flood zone. <br />WHEREAS, LIVERMORE is currently negotiating with the Alameda County Flood Control and <br />Water Conservation District, Zone 7 ("Zone 7") for reimbursement from Zone 7 for all or <br />part of the proposed Livermore Flood Protection Improvements. Both LIVERMORE and <br />AUTHORITY wish to cooperate to fairly share the costs of both El Charro Road and the <br />Livermore Flood Protection Improvements, which costs include the cost of design, <br />construction, mitigation and any lease of land. <br />WHEREAS, It is the intent of LIVERMORE, PLEASANTON, and AUTHORITY to cooperate to <br />facilitate the development of the El Charro Specific. Plan and Staples Ranch Property. <br />WHEREAS, It is the intent of all parties to work to secure Zone 7 approval of a cost effective <br />Livermore Flood Protection Improvements project that is eligible for reimbursement <br />and/or exemption credits, to obtain reimbursement for Livermore Flood Protection <br />Improvements required for these developments and to have Zone 7 prioritize these <br />improvements in their StreamWISE program. <br />WHEREAS, LIVERMORE and PLEASANTON agree to work together to secure Caltrans approval of <br />any additional improvements required for the Caltrans I-580/Fallon Road Interchange <br />Modification Project No. 04-257604. <br />WHEREAS, All parties wish to enter into a cost sharing agreement for the improvements which are <br />mutually beneficial to LIVERMORE and PLEASANTON and AUTHORITY. <br />WHEREAS, The PLEASANTON City Council, having considered the merits of a proposed Cost <br />Sharing Agreement between the cities of LIVERMORE and PLEASANTON and the <br />SURPLUS PROPERTY AUTHORITY OF ALAMEDA COUNTY, finds that it is in the <br />best interest of PLEASANTON to enter into such Agreement. <br />2 <br />
