Resolution No. PC-2007-34 <br />Page Two <br />WHEREAS, at the public hearing on June 27, 2007, the Planning Commission <br />determined that the Final EIR does not conform to the California <br />Environmental Quality Act (CEQA) requirements and, therefore, could not <br />make the environmental findings for the project. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES AS FOLLOWS: <br />Section 1. Declines certification of the Final EIR for PUD-33, the application of James <br />Tong/Charter Properties, and Jennifer Lin, Frederic Lin, and Kevin Lin for <br />Planned Unit Development development plan approval for the Oak Grove <br />development to subdivide an approximately 562-acre site into 51 custom <br />home sites and to designate the remaining area for permanent open <br />space for the property located at 1400 Hearst Drive, near the present <br />terminus of Hearst Drive on the southerly sides of the Vintage Hills and <br />the Grey Eagle Estates developments. <br />Section 2.
