<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2007-34 <br /> <br />RESOLUTION DECLINING CERTIFICATION OF THE FINAL ENVIRONMENTAL <br />IMPACT REPORT FOR THE APPLICATION OF JAMES TONG/CHARTER <br />PROPERTIES, AND JENNIFER LIN, FREDERIC LIN, AND KEVIN LIN, <br />AS FILED UNDER CASE PUD-33 <br /> <br />WHEREAS, James Tong/Charter Properties, and Jennifer Lin, Frederic Lin, and Kevin <br />Lin have applied for a Planned Unit Development development plan <br />approval for the Oak Grove development to subdivide an approximately <br />562-acre site into 51 custom home sites and to designate the remaining <br />area for permanent open space for the property located at 1400 Hearst <br />Drive, near the present terminus of Hearst Drive on the southerly sides of <br />the Vintage Hills and the Grey Eagle Estates developments; and <br /> <br />WHEREAS, a Draft Environmental Impact Report (EIR) for the project was published <br />on June 20, 2006 and proper legal notice of preparation and the <br />availability of the Draft EIR was provided; and <br /> <br />WHEREAS, the Planning Commission held a noticed public hearings on July 12, 2006 <br />and August 28, 2006, during the forty-five-day comment period after the <br />Draft EIR was published, to receive comments on the Draft EIR; and <br /> <br />WHEREAS, comments regarding the Draft EIR from public agencies having jurisdiction <br />by law, persons having special expertise with respect to any <br />environmental impacts involved, and other persons and organizations <br />having an interest in the project were accepted and responded to; and <br /> <br />WHEREAS, the Final EIR for the project for the project has been prepared and <br />contains the Draft EIR, comments and recommendations received on the <br />Draft EIR, and the responses to comments raised regarding environmental <br />issues in the review and consultation process; and <br /> <br />WHEREAS, proper notice of completion of the Final EIR for the project was provided, <br />and <br /> <br />WHEREAS, the Planning Commission held noticed public hearings on June 13, 2007 <br />and June 27, 2007 to take and consider all public testimony concerning <br />the completeness and adequacy of the Final EIR, relevant exhibits, and <br />recommendations of City staff concerning this application. <br /> <br />
