PC-2007-34, PUD-33, TONG-LIN; OAK GROVE

PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-2007-34 RESOLUTION DECLINING CERTIFICATION OF THE FINAL ENVIRONMENTAL IMPACT REPORT FOR THE APPLICATION OF JAMES TONG/CHARTER PROPERTIES, AND JENNIFER LIN, FREDERIC LIN, AND KEVIN LIN, AS FILED UNDER CASE PUD-33 WHEREAS, James Tong/Charter Properties, and Jennifer Lin, Frederic Lin, and Kevin Lin have applied for a Planned Unit Development development plan approval for the Oak Grove development to subdivide an approximately 562-acre site into 51 custom home sites and to designate the remaining area for permanent open space for the property located at 1400 Hearst Drive, near the present terminus of Hearst Drive on the southerly sides of the Vintage Hills and the Grey Eagle Estates developments; and WHEREAS, a Draft Environmental Impact Report (EIR) for the project was published on June 20, 2006 and proper legal notice of preparation and the availability of the Draft EIR was provided; and WHEREAS, the Planning Commission held a noticed public hearings on July 12, 2006 and August 28, 2006, during the forty-five-day comment period after the Draft EIR was published, to receive comments on the Draft EIR; and WHEREAS, comments regarding the Draft EIR from public agencies having jurisdiction by law, persons having special expertise with respect to any environmental impacts involved, and other persons and organizations having an interest in the project were accepted and responded to; and WHEREAS, the Final EIR for the project for the project has been prepared and contains the Draft EIR, comments and recommendations received on the Draft EIR, and the responses to comments raised regarding environmental issues in the review and consultation process; and WHEREAS, proper notice of completion of the Final EIR for the project was provided, and WHEREAS, the Planning Commission held noticed public hearings on June 13, 2007 and June 27, 2007 to take and consider all public testimony concerning the completeness and adequacy of the Final EIR, relevant exhibits, and recommendations of City staff concerning this application.
