EXHIBIT B CONDITIONS OF APPROVAL PCUP-65, Nick Kavayiotidis, Petra Realty Investors, Inc. 5980 and 5998 Sunol Boulevard June 27, 2007 GENERAL 1. Development shall be constructed substantially as shown on the plans, color/material board, U.S. Green Building Council LEED Checklist, and related materials, Exhibit A, dated “Received” March 16, and May 22, 2007, on file with the Planning Department, except as modified by the following conditions. Minor changes to the plans may be allowed subject to the approval of the Planning Director if found to be in substantial conformance to the approved exhibits. 2. The applicant shall obtain all building and other applicable City permits for the project prior to the commencement of construction. 3. The developer shall pay any and all fees to which the property may be subject prior to issuance of building permits. The type and amount of the fees shall be those in effect at the time the building permit is issued. 4. The PUD development plan approval shall lapse two years from the effective date of this ordinance unless a building permit is issued and construction has commenced and is diligently pursued toward completion. 5. All conditions of approval for this case shall be reprinted and included as a plan sheet(s) with the building permit plan check sets submitted for review and approval. These conditions of approval shall be on, at all times, all grading and construction plans kept on the project site. 6. Prior approval from the Planning Department must be received before any changes are constituted in site design, grading and drainage, building design, building colors or materials, landscape material, etc. PLANNING 7. The site development standards for the subject properties shall follow the Office District of the Pleasanton Municipal Code, except as modified by the North Sycamore Specific Plan and the conditions of approval for Case PUD-65. 1
