participation in such a program, the City may withhold building permits if the City <br />determines that sufficient water is not available at the time of application of <br />building permits. <br /> <br />8. The building permit plan check materials will be accepted for submittal only after <br />completion of the 15-day appeal period, measured from the date of the approval <br />letter, unless the project developer submits a singed statement acknowledging <br />that the plan check fees may be forfeited in the event that the approval is <br />overturned on appeal, or that the design is significantly changed as a result of the <br />appeal. In no case will a building permit be issued prior to the expiration of the <br />15-day time period. <br /> <br />9. All conditions of approval for this case shall be reprinted and included as a plan <br />sheet(s) with the building permit plan check sets submitted for review and <br />approval. These conditions of approval shall be on, at all times, all grading and <br />construction plans kept on the project site. <br /> <br />10. Prior approval from the Planning Department must be received before any <br />changes are constituted in site design, grading, building design, building colors or <br />materials, landscape material, etc. <br /> <br />11. The applicant shall pay traffic impact fees as determined by the traffic analysis by <br />Fehr & Peers as reviewed and approved by the City Traffic Engineer. The <br />applicant may be required to improve intersections unknown at this time based <br />on the traffic analysis. Any design or improvement plans for intersections shall <br />be submitted to the Department of Public Works for review and approval prior to <br />building permit issuance. The City Engineer and City Traffic Engineer may waive <br />the requirements for those improvements and require an additional fair share <br />cost that shall be a cost over and above the traffic impact fees, if required. The <br />applicant shall pay all fees at the time of issuance of the first building permit on <br />the site. <br /> <br />12. The property owner/developer shall record cross ingress/egress access <br />agreements with 3550 Stanley Boulevard and 3551 Bernal Avenue. Wording for <br />parking agreements and easements shall be submitted to the City Attorney for <br />review and approval. <br /> <br />PLANNING <br /> <br />13. At no time shall balloons, banners, pennants, or other attention-getting devices <br />be utilized on the site except as allowed by Section 18.96.060K of the Zoning <br />Ordinance for grand openings or by Section 18.116.040 of the Zoning Ordinance <br />if approved by temporary conditional use permit as part of a decorating plan in <br />conjunction with shopping center promotional events. At no time shall spot <br />lighting be used after 10:00 PM in conjunction with such grand openings and/or <br />promotional events. <br />3 <br /> <br /> <br />
