II. Noise, odor, and illumination associated with the operation of the <br />asphalt batch plant on the RMC/Lonestar property easterly of the lots <br />covered by this development plan. The City is taking all reasonable <br />steps to relocate the plant. <br />c. An easement for noise/dust/vibration. <br />d. A disclosure statement indicating the close proximity of the Vineyard Avenue <br />Corridor Specific Plan area to the Livermore Municipal Airport and of possible <br />impacts, including but not limited to noise and vibration, to homes due to aircraft <br />over flights. <br />e. A disclosure stating that the East bay Regional Park District operates Shadow <br />Cliffs Regional Recreation Area, a regional recreation facility, and that the buyer <br />recognizes that the activities that take place in the "Regional Recreation Area" <br />may result in noise, odors, dust, traffic or other conditions that may affect the lots <br />covered by this PUD Development Plan. <br />I. A disclosure describing the planned use and construction of the Old <br />Vineyard Road right-of--way for public trail uses and disclosing the <br />potential for a gate to be constructed by the EBRPD at some point along <br />the Vineyard Avenue Trail (Old Vineyard Avenue). <br />II. A disclosure of the future staging area and parking area to be owned and <br />operated by the East Bay Regional Park on a portion of Old Vineyard <br />Avenue right-of--way, and the proposed City Park to be located on the <br />old landfill site on the south side of Vineyard Avenue. <br />III. A disclosure of the potential for vehicle parking along the Old Vineyard <br />Avenue and in adjacency to the Shadow Cliffs Recreational Area access <br />gate. <br />f. A disclosure on all lots regarding the underground, 230-kilovolt electrical <br />transmission line in the right-of--way of new Vineyard Avenue. <br />g. A disclosure of the nearby sanitary sewer pump station with standby diesel <br />generation on new Vineyard Avenue. <br />28. Wording for all disclosures, deed restrictions, and clauses shall be submitted to the City <br />Attorney for review and approval before City Council approval of the first final subdivision <br />map for this development and shall be recorded over the project site by separate instrument. <br />Building Conditions <br />29. The project developer shall obtain a building permit from the Building and Safety Division <br />and any other applicable City permits for the project prior to the commencement of any <br />construction. <br />
