building permits to ensure that all recommendations have been properly implemented. <br />The consultant shall certify in writing that such recommendations have been followed. <br />51. Except as allowed by Condition No. 31 above, no trees shall be removed from the site. <br />The applicants shall be responsible for the loss of any tree not previously approved for <br />removal. For trees that are removed during construction, the applicants shall pay a fine in <br />the amount equal to the appraised value of the subject tree. The applicants shall post <br />cash, letter of credit, certificate of deposit (CD), or other security satisfactory to the <br />Planning Director in the amount of $5,000 for each tree required to be preserved, up to a <br />maximum of $25,000. This cash bond or security shall be retained for one year following <br />completion of construction and shall be forfeited if the trees are removed, destroyed, or <br />disfigured. If the fine based on the appraised value of the tree(s) exceeds the bond <br />amount, the applicants shall pay the difference between the bond and the appraised value <br />of the subject tree(s). <br />52. The following tree preservation methods shall be followed during construction of the site. <br />These methods shall be listed on the building permit plans and shall include, but not be <br />limited to, the following: <br />a. No existing tree may be trimmed or pruned without prior approval by the Planning <br />Director. Any City approved pruning of existing trees shall be performed by a <br />certified arboristNo equipment shall be operated or stored within the dripline of any <br />tree. <br />b. No trenching for utilities or irrigation shall take place within the driplines of existing <br />trees without prior approval by the Planning Director. <br />Temporary chain link fencing shall be installed around the existing trees surrounding <br />the building pads. No equipment may be operated within or beneath the driplines of <br />these trees, and no equipment or temporary structures shall be placed within or <br />beneath the driplines of these trees. Fencing shall remain in place until completion of <br />construction; removal of such fencing prior to that time may result in a "stop work" <br />order. <br />d. No oil, gasoline, chemicals, or other harmful materials shall be deposited or disposed <br />within the dripline of the trees or in drainage channels, swales, or areas that may lead <br />to the dripline. <br />e. No stockpiling/storage of fill, etc., shall take place underneath or within 5' of the <br />dripline of the existing trees. <br />Failure to comply with any of these requirements may result in a "stop-work" order. <br />11 <br />
