CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 88-353 RESOLUTION DENYING THE APPEAL OF THE CITY COUNCIL OF A DECISION OF THE PLANNING COMMISSION APPROVING THE APPLICATION OF PAUL CREAMER FOR A CONDITIONAL USE PERMIT FOR MOUNTAIN MIKE'S AT 5424 SUNOL BOULEVARD (AP-88-15/UP-88-21) WHEREAS, at its meeting of June 22, 1988, the Planning Commission approved the application of Paul Creamer for a conditional use permit to operate a take-out food establishment, video arcade, and to serve alcoholic beverages after 10:00 p.m., on the premises to be located at 5424 Sunol Boulevard; and WHEREAS, this matter was appealed by the City Council so they could review the application totally; and WHEREAS, a public hearing was held before the City Council on July 19, 1988, at which time pertinent testimony and documents wee reviewed; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Denies the appeal of the City Council of a decision of the Planning Commission and therefore approves Case UP-88-21, the application of Paul Creamer for a conditional Use permit to operate a take-out food establishment (Mountain Mike's), video arcade, and to serve alcoholic beverages after 10:00 p.m. on the premises to be located at 5424 Sunol Boulevard (AP-88-14), subject to the following conditions: 1. That the proposed use shall be operated in substantial conformance with the description on file with the Planning Department dated May 18, 1988. Hours of operation shall be 11:30 a.m. to 12 midnight. At no time shall the use be modified such that alcoholic beverages are sold without food. 2. That the applicant shall be limited to a maximum of five electronic games at one time. 3. That in the event nuisances are created through the operation of the restaurant use,
