CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-353 <br /> <br /> RESOLUTION DENYING THE APPEAL OF THE CITY <br /> COUNCIL OF A DECISION OF THE PLANNING <br /> COMMISSION APPROVING THE APPLICATION OF <br /> PAUL CREAMER FOR A CONDITIONAL USE PERMIT <br /> FOR MOUNTAIN MIKE'S AT 5424 SUNOL <br /> BOULEVARD (AP-88-15/UP-88-21) <br /> <br />WHEREAS, at its meeting of June 22, 1988, the Planning <br /> Commission approved the application of Paul Creamer <br /> for a conditional use permit to operate a take-out <br /> food establishment, video arcade, and to serve <br /> alcoholic beverages after 10:00 p.m., on the <br /> premises to be located at 5424 Sunol Boulevard; <br /> and <br /> <br />WHEREAS, this matter was appealed by the City Council so <br /> they could review the application totally; and <br /> <br />WHEREAS, a public hearing was held before the City Council <br /> on July 19, 1988, at which time pertinent testimony <br /> and documents wee reviewed; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Denies the appeal of the City Council of a <br /> decision of the Planning Commission and therefore <br /> approves Case UP-88-21, the application of Paul <br /> Creamer for a conditional Use permit to operate a <br /> take-out food establishment (Mountain Mike's), <br /> video arcade, and to serve alcoholic beverages <br /> after 10:00 p.m. on the premises to be located at <br /> 5424 Sunol Boulevard (AP-88-14), subject to the <br /> following conditions: <br /> <br /> 1. That the proposed use shall be operated in <br /> substantial conformance with the description <br /> on file with the Planning Department dated <br /> May 18, 1988. Hours of operation shall be <br /> 11:30 a.m. to 12 midnight. At no time shall <br /> the use be modified such that alcoholic <br /> beverages are sold without food. <br /> <br /> 2. That the applicant shall be limited to a <br /> maximum of five electronic games at one time. <br /> <br /> 3. That in the event nuisances are created <br /> through the operation of the restaurant use, <br /> <br /> <br />
