room, pool room, library, swimming pool, laundry room etc.). In addition, in March 2006 <br />the park management put together a more detailed description of maintenance items <br />that it would undertake during specified months, such as bringing in a dumpster for all <br />residents' use and trimming the mulberry trees by the end of September (to avoid the <br />accumulation of leaves in the streets). A copy of those standards is also attached to <br />this report as Exhibit 2. <br />Notwithstanding these standards, not all the residents within the HMP have been <br />satisfied with the park owner's maintenance of the park. On April 17, 2007, a number of <br />residents voiced their concern to the City Council (under Meeting Open to the Public) <br />about the condition of the park. A copy of those minutes are attached to this report as <br />Exhibit 3. In general, there were comments that the maintenance standards, whether <br />under the agreement or otherwise, were not being observed rigorously. In particular, <br />there was concern that the condition of some of the sidewalks made it unsafe for <br />residents to use the sidewalks, especially at night. <br />After hearing the residents, Council directed staff to review the conditions at the park <br />with the owner and then to make a report to Council. <br />DISCUSSION <br />The park owner attempted to address the most hazardous of the sidewalk conditions by <br />concrete ramps. The owner and the park on site management personnel have met with <br />resident groups on a monthly basis since June, including a walk through of the park in <br />which sidewalks, fences, and trees were inspected. The owner has encouraged <br />residents to put into writing their concerns about maintenance issues and has promised <br />to hold monthly meetings with the residents at which their concerns about maintenance <br />issues may be voiced. <br />In August, the clubhouse is scheduled to be fully cleaned including professional carpet <br />cleaning. Street lights are being replaced throughout the park with new energy efficient <br />bulbs. The sidewalk slabs with the most significant displacement are scheduled to be <br />removed and replaced before the Council's August 21 meeting and, with the City's <br />permission, certain trees that are causing the sidewalks' displacement, will be <br />removed. The owner believes that the monthly maintenance standards (Exhibit 2) have <br />all been met. <br />From the comments made by the residents, staff believes that additional items still need <br />to be addressed such as replacing a water heater in the laundry room, replacing <br />inoperable washers/dryers in the laundry room, and installing hand railings at the exits <br />from the clubhouse to the pool deck. The residents also feel that the park landscaping <br />has been allowed to deteriorate. The park owner, however, has indicated to staff that <br />these items will be addressed in the near future and, in particular, the irrigation system <br />(to support the landscaping) will be renovated. <br />Page 3 of 4 <br />
