CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-593 <br /> <br /> RESOLUTION DENYING THE APPEAL BY WIT,T.TAM <br /> DAVIS OF A DECISION OFT HE PLANNING <br /> COMMISSION APPROVING THE APPLICATION OF <br /> CHART~S AND ROSE MCCRACKEN FOR A <br /> CONDITIONAL USE PERMIT TO OPERATE A <br /> RECREATIONAL FACILITY IN CONJUNCTION WITH <br /> A PROPOSED WHOLESALE BUSINESS <br /> ESTABLISPIMENTTO BE LOCATED AT 7039 <br /> COMMERCE CIRCLE (AP-88-30/UP-88-57) <br /> <br />WHEREAS, at its meeting of November 22, 1988, the Planning <br /> Commission approved the application of Charles and <br /> Rose McCracken for a conditional use permit to <br /> operate a recreational facility (indoor batting <br /> range) in conjunction with a proposed wholesale <br /> business establishment (silk screening and <br /> embroidery) to be located at 7039 Commerce Circle <br /> (Case UP-88-57); and <br /> <br />WHEREAS, within the time specified by the Pleasanton <br /> Municipal Code, William Davis submitted an appeal <br /> to the City Clerk of the City of Pleasanton; and <br /> <br />WHEREAS, a public hearing was held before the City Council <br /> on December 20, 1988 at which time all relevant <br /> testimony was considered and all relevant documents <br /> were reviewed; and <br /> <br />WHEREAS, after a review of the material presented, the City <br /> Council makes the following findings: <br /> <br /> a. That the proposed location of the conditional <br /> use is in accordance with the objectives of <br /> Chapter 18,124 of the Pleasanton Municipal <br /> Code and the purpose of the district in which <br /> the site is located. <br /> <br /> b. That the proposed location of the conditional <br /> use and the conditions under which it would be <br /> operated or maintained will not be <br /> detrimental to the public health, safety, or <br /> welfare, or be materially injurious to the <br /> properties or improvements in the vicinity. <br /> <br /> c. That the proposed conditional use will comply <br /> with each of the applicable provisions of <br /> Chapter 18.124 of the Pleasanton Municipal <br /> Code. <br /> <br /> <br />
