CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-521 <br /> <br /> RESOLUTION GRANTING THE APPEAL OF A <br /> DECISION OF THE BOARD OFADJUSTMENT <br /> DENYING THEAPPLICATION OF RAYMOND BOPIN <br /> FOR A VARIANCE TO AT~OWRETENTION OF AN <br /> ACCESSORY STRUCTURE AT 6824 CORTE DE <br /> FLORES (V-88-19/AP-88-21) <br /> <br />WHEREAS, at its meeting of September 14, 1988, the Board of <br /> Adjustment denied the application of Raymond Bohn <br /> for a variance from the Municipal Code to allow <br /> retention of an accessory structure that encroaches <br /> into the required sideyard setback of the property <br /> located at 6824 Corte de Flores; and <br /> <br />WHEREAS, within the time specified by the Pleasanton <br /> Municipal Code, the applicant submitted an appeal <br /> to the City Clerk of the City of Pleasanton; ;and <br /> <br />WHEREAS, a duly noticed public hearing was held before the <br /> City Council on October 18, 1988 at which time <br /> the applicant and other members of the public were <br /> offered an opportunity to present evidence <br /> regarding this appeal; and <br /> <br />WHEREAS, on October 18, 1988, a resolution was made to grant <br /> the appeal in question, but the vote thereon was 2- <br /> 2, and the matter was continued to November 1, 1988 <br /> for action by the entire City Council; and <br /> <br />WHEREAS, on November 1, 1988, after a review of the material <br /> presented, the City Council makes the following <br /> findings: <br /> <br /> a. That special circumstances unique to the site <br /> can be found. <br /> <br /> b. That the proposal will not constitute a grant <br /> of special privilege. <br /> <br /> c. That the health, safety and general welfare of <br /> the surrounding area are not jeopardized by <br /> the request. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Grants the appeal of Raymond Bohn and therefore <br /> approves the application for a variance from the <br /> <br /> <br />
