WHEREAS, this City Council has heretofore entered <br />into an agreement with the Corporation, dated as of August 1, <br />1986, as amended by Amendment No. 1 to said agreement <br />(together, the "Agreement") to provide. for the acquisition and <br />improvement by the Corporation of certain real property, and <br />hereby determines it is necessary and desirable and in the <br />public interest for the City to enter into an Amendment No. 2 <br />to the Agreement with the Corporation to provide for the <br />acquisition and construction of the Project; <br /> <br /> WHEREAS, the City desires to transfer to the <br />Corporation sums of money which shall be used by the <br />Corporation solely for the purposes of acquiring and <br />constructing the Project and all amounts necessary to pay <br />incidental costs incurred by the Corporation in said <br />acquisition and construction; and <br /> <br /> WHEREAS, the City has full legal right, power and <br />authority under the Constitution and the laws of the State of <br />California to enter into the transactions hereinafter <br />authorized; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council <br />of the City of Pleasanton, as follows: <br /> <br /> Section 1. All of'the recitals herein contained are <br />true and correct and this City Council so finds. <br /> <br /> Section 2. The construction bid of MJB Pipeline for <br /> as corrected, <br />Schedule I,/being the lowest responsible construction bid for <br /> <br /> 3 <br />4614M-040482 -000015-165 04/07/89 <br /> <br /> <br />
