Job No. 16158-0 <br /> <br /> EXHIBIT A <br /> Page 3 of 4 <br /> <br />PART V - RESPONSIBILITIES OF CITY OR OTHERS <br /> <br />The CITY or others are responsible for the following items. This is not intended to be a <br />complete list. <br /> <br /> 1. To provide guidance and advice from CITY's legal counsel as to the need for, and <br /> the procedures for obtaining approvals, permits or other licenses from <br /> governmental agencies. CONSULTANT will actively participate in the permit <br /> process but the primary responsibility in this regard shall remain with the CITY. <br /> <br /> 2. All work pertaining to the Environmental Impact Report and/or Environmental <br /> Clearance Application, if required. <br /> <br /> 3. To secure permission of property owners for the CONSULTANT to enter upon the <br /> properties when necessary to accomplish the work. <br /> <br /> 4. To bear the cost of digging up and exposing utility locations, both on-site and off- <br /> site, if in the opinion of the CONSULTANT, it becomes necessary and desirable to <br /> do so in order to ascertain the location and elevation information. <br /> <br /> 5. To provide current title report with supporting documents to CONSULTANT. <br /> <br /> 6. The design of electrical systems. <br /> <br /> 7. To obtain permission from property owners if any work or investigation is <br /> required to be done on their property. <br /> <br /> 8. To perform any "inspection" as to adequacy or completeness of work performed by <br /> CITY or contractors. <br /> <br /> 9. Safety and Supervision: It is specifically noted that the CITY or others are in <br /> responsible charge of the construction project. That CONSULTANT has no <br /> responsibility for safety matters or the quality or accuracy of work performed by <br /> CITY'S contractors. That CONSULTANT does not supervise the contractor or the <br /> CITY'S project representative. <br /> <br /> 10. CITY agrees CONSULTANT will not perform on-site construction review, <br /> construction management, supervision of construction of engineering structures, <br /> or other construction supervision for this project unless specifically provided for <br /> in this agreement, and that such services will be performed by others, and CITY <br /> will defend, indemnify, and hold CONSULTANT harmless from any and all <br /> liability arising from or resulting from the performance of construction review, <br /> construction management, supervision of construction of engineering structures <br /> or other construction supervision by other persons or entities. <br /> <br /> <br />
