This ev- <br />idence shall include a reference to all required State Highway <br />Encroachment permits. <br /> <br /> (11) To apply for necessary Encroachment Permits for <br />required work within State Highway right of way, in accordance <br />with STATE's standard permit procedures, as more specifically de- <br />fined in Articles (5), (6) and (7) of Section III of this Agree- <br />ment. <br /> <br /> (12) To advertise, award and administer the contract <br /> to construct PROJECT in accordance with the requirements of the <br /> State Contract Act and the California Labor Code, including its <br /> prevailing wage provisions. The construction contract shall also <br /> comply with the Disadvantage Business Enterprise (DBE) program <br /> CITY has established for those activities using Federal Funds, if <br /> the program has been approved in the previous year. Otherwise <br /> CITY shall prepare or update the program and submit that program <br /> to STATE's Division of Local Streets and Roads for approval or <br /> use STATE's process and goals. <br /> <br /> (13) To construct the PROJECT in accordance with plans <br /> and specifications of CITY, to the satisfaction of and subject to <br /> the approval of STATE. <br /> <br /> (14) To administer the contract under the general <br /> supervision of a Resident Engineer, who shall be a licensed Civil <br /> <br /> -5- <br /> <br /> <br />
