No. 4-I1~9-C <br /> <br />rights of way required for PROJECT, prepare the contract docu- <br />ments, advertise, award and administer the construction contract <br />for PROJECT, and bear all the costs thereof. <br /> <br /> (4) Landscaping of PROJECT will be performed under a <br /> <br />separate contract upon completion of PROJECT and will be covered <br />in a separate future Cooperative Agreement. <br /> <br /> (5) The parties hereto desire to define herein the <br />terms and conditions under which rights of way are to be acquired <br />and the PROJECT is to be designed, constructed, financed and <br />maintained. <br /> <br /> SECTION I <br /> <br />CITY AGREES: <br /> <br /> (1) To provide, at no cost to STATE, all necessary <br />PS&E and right of way acquisition services, including utility <br />identification and location; all subject to review and approval <br />by STATE, to assure compliance with applicable Federal and State <br />regulations and STATE'S established practices, including the <br />Standard Specifications, Standard Plans and drafting procedures. <br /> <br /> (2) If a consultant is used to prepare PS&E and/or ad- <br />minister the construction contract for PROJECT, to follow the <br />Consultant Selection Procedures for Federally-funded Highway <br />Projects specified in Volume I Section II of STATE's current Lo- <br />cal Programs Manual. <br /> <br /> (3) To perform all right of way activities, at no cost <br />to STATE, in accordance with procedures acceptable to STATE, and <br /> <br /> -2- <br /> <br /> <br />
