Res. 2435 <br />3/14/84 <br />Page 2 <br />2. That prior to issuance of a building permit, plans for <br />all fencing on the site shall be submitted to the Planning <br />Division for approval. In addition to the fencing shown <br />on the development plan, a minimum 6 ft. high solid wooden <br />fence shall be constructed along the entire length of <br />the western property line of the subject property, exclusive <br />of the setback and a minimum 6 ft. high masonry fence shall be <br />constructed along the entire eastern property line exclusive <br />of setback. This fence shall be installed and terraced <br />from the lowest point on the property adjoining the Mavis <br />Street residences. <br />3. That no parking shall be allowed on the south side of <br />Vineyard Avenue in front of the subject property in order <br />to allow proper ingress and egress to the subject site. <br />4. That the property shall be subdivided for sale and condominium <br />purposes prior to issuance of a building permit. <br />5. That prior to the filing of a final map on the subject <br />property, CC&Rs shall be approved by the City Attorney; <br />these CC&Rs shall provide for a property owners association <br />with sufficient power to manage all commonly owned areas. <br />The City shall be named as third party beneficiary of <br />said CC&Rs and shall be granted the power to enforce <br />its provisions if the property owners association fails ,-~ <br />to do so. The Mavis Street residents shall have the <br />opportunity to have input into the preparation of the <br />CC&Rs. <br />6. That the interior streets within this development be <br />private and maintained by the homeowners' association. <br />7. That a curb to curb public service easement be granted <br />over the interior streets. <br />8. That the water and sanitary sewer systems be public and <br />be within the P.S.E. <br />9. That the storm drainage and street lighting systems within <br />this development be private and be maintained by the <br />homeowners' association. <br />10. That the developer be aware that litigation is pending <br />regarding the downstream storm drainage system discharge <br />north of Vineyard Avenue. Completion of this development <br />may contribute to the problem by increasing the peak <br />run-off. The developer may be subject to some undetermined <br />degree of liability pending the outcome of possible litigation. <br />11. That the minimum rear setback of the attached homes on <br />the east side of the property line shall be 35'. ,"~ <br />12. That because of the project will create unacceptable <br />traffic levels on Vineyard Avenue just east of First <br />Street, no grading or building permits shall be issued <br />for any portion of the project until construction has <br />commenced on all improvements necessary to connect Valley <br />Avenue to Bernal Avenue. <br />
