WHEREAS, the Final EIR consists of the Draft EIR, as revised <br /> and supplemented, made a part of the Agency's <br /> Report on the Redevelopment Plan, incorporating all <br /> comments received and the response of the Agency <br /> and the Council thereto as of the date hereof; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The Council has considered the Final <br /> Environmental Impact Report as prepared by the <br /> Agency and evaluated all comments, written and <br /> oral, received from persons who have reviewed the <br /> Draft EIR. <br /> <br />Section 2: The Council hereby finds and determines that with <br /> respect to the significant environmental effects <br /> identified in the Final EIR, which significant <br /> environmental effects are set forth in Exhibit A, <br /> attached hereto and incorporated herein by <br /> reference, changes or alterations have been <br /> required in, or incorporated into, the proposed <br /> Downtown Redevelopment Project which avoid or <br /> substantially lessen such significant environmental <br /> effects. The facts supporting this finding as to <br /> each identified significant effect are also <br /> contained in Exhibit A. Based on such findings and <br /> statements of facts, the Council hereby finds that <br /> significant environmental effects have been reduced <br /> to an acceptable level in that all significant <br /> environmental effects have been avoided or <br /> substantially lessened except for the following: <br /> <br /> Traffic Circulation: An unacceptable level of <br /> service will exist at the intersection of Sunol <br /> Boulevard/Ray Street-Vineyard Avenue. <br /> <br /> Based on the foregoing, the Council finds and <br /> determines that the Downtown Redevelopment Project <br /> will have a significant effect upon the <br /> environment. <br /> <br />Section 3: Prior to approving the expenditure of funds by <br /> the Agency in connection with the construction or <br /> installation of any of the public improvements or <br /> facilities contemplated by the Redevelopment Plan <br /> or in connection with the disposition of land by <br /> the Agency for private development, if such <br /> approval is required, the Council shall find that <br /> the mitigation measures identified in Exhibit A <br /> will be satisfactorily complied with as they <br /> pertain to any such activity~ Such finding shall <br /> be based upon information contained in a report <br /> concerning the proposed activity which shall be <br /> <br /> -2- <br /> <br /> <br />
