assessment, you must make the finding that the mitigated negative <br />declaration is appropriate for the project. The finding must <br />be made prior to taking action on the project itself. in making <br />this finding you should review the contents of Resolution No. <br />77-66 (Environmental Impact Guidelines and Procedures). Please <br />refer to page 8 of the Guidelines for the definition of signi- <br />ficant effect and pages 20 through 22 of the Guidelines for the <br />details on determining significant effect. <br />Staff Recommendation: The staff concurs with the action takti^.n <br />by the City Council on May 11, 1582. We feel that the realign- <br />ment of Johnson Drive would provide superior access to not only <br />the Reynolds and Brown property but the Harris Realty, Denny's <br />and Hungry Hunter sites. We feel that it would also improve the <br />intersection of Johnson Drive and Hopyard Road thereby lesseni,ny <br />the potential for traffic congestion in this area in the future. <br />For this reason, we recommend approval of the modification of <br />the Reynolds and Brown second phase PUD as shown on the deve].cp- <br />ment plan for case PUD-82-12 subject to all conditions contained <br />in Planning Commission Resolution No. 2156, but modifying con- <br />ditions number 1 and 7 of that resolution as shown in the <br />attached letter to Tom Terrell dated 5/20/82; adding condi,tic,is <br />11, 12 as shown in that same letter; modifying condition number 2 <br />of Resolution No. 2156 as follows: <br />2. Buildings on the two lots immediately to the east <br />_ of the north/south leg of Owens Court originally <br />received design approval as part of case PUD-80-14F <br />Approval of the development plan for case <br />PUD-82-12 supercedes the original approval for <br />these two buildings and their design shall be <br />resubmitted at a later date. <br />And adding condition number 13 to Resolution No. 2156 which reads as <br />follows: <br />13. That all buildings and/or structures must comply <br />with all codes and ordinances in effect at the <br />time required permits are issued by the building <br />division. <br />-4- <br />
