CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-59 <br /> <br /> RESOLUTION APPROVING CASE SP-88-2, THE <br /> APPLICATION OF TMI ANALYSTS, THE DESILVA <br /> GROUP, AND THE CITY OF PT~ASANTON FOR A <br /> SPECIFIC PLAN <br /> <br />WHEREAS, the City Council considered an application to adopt the <br /> Laguna Oaks Specific Plan for a 155 acre site located in <br /> the northwest corner of the intersection of 1-680 and <br /> Bernal Avenue; and <br /> <br />WHEREAS, at its duly noticed public hearing of February 7, 1989, <br /> the City Council considered all public testimony, <br /> relevant exhibits and recommendations of the City staff <br /> concerning this application; and <br /> <br />WHERES, the City Council adopted a Draft and Final EIR at its <br /> meeting of March 9, 1988 regarding this site, and <br /> certified the EIR as complete and adequate; ;and <br /> <br />WHEREAS, the EIR indicates that significant environmental effects <br /> would result from the project, as summarized in the <br /> Environmental Impact Findings, Exhibit "A" attached <br /> hereto and made part of this case by reference; and <br /> <br />WHEREAS, CEQA and state and local EIR guidelines adopted pursuant <br /> thereto require the City Council to make specific <br /> findings where an EIR identifies one or more significant <br /> effects which may result from approval of the project; <br /> and <br /> <br />WHEREAS, this City Council finds that potentially significant <br /> environmental effects either (1) have been mitigated by <br /> project conditions of approval or modifications made to <br /> the project during the review process, (2) require <br /> mitigation by another public agency having jurisdiction <br /> or (e) cannot be mitigated except by mitigation measures <br /> or alternatives found to be infeasible given economic, <br /> social environmental, and other considerations, which <br /> facts supporting these findings are summarized in the <br /> Environmental Impact Findings, Exhibit "A", which can be <br /> reviewed at the Planning Department, 200 Old Bernal <br /> Avenue, Pleasanton, California, and as are more fully <br /> found in the administrative record of this project; and <br /> <br />WHEREAS, this City Council finds that although most significant <br /> environmental effects have been reduced to a level of <br /> insignificance, the remaining, unavoidable, significant <br /> <br /> -1- <br /> <br /> <br />
