PLANNING COMMISSION <br />CITY OF PLEASANTON <br />ALAMEDA COUNTY <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2006 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY <br />OF PLEASANTON RESCINDING THE APPEAL OF A DECISION OF <br />THE DIRECTOR OF PLANNING AND COMMUNITY DEVELOPMENT <br />APPROVING A MINOR MODIFICATION FOR CASE PUD-80-1 FOR <br />CPS & ASSOCIATES <br />WHEREAS, Valley Business Associates (CPS Property Management Co., Inc.) <br />has requested a modification to the street pattern approved <br />as part of PUD-BO-1 and to the number, shapes and sizes of <br />lots within that development; and <br />WHEREAS, the approved plan shows 49 lots bordering on two semi-circular <br />interior streets; and <br />WHEREAS, the proposed revisions show 40 lots and a rectangular interior <br />street system; and <br />WHEREAS, where the minimum distance from the interior streets to the <br />residences bordering the property on the west was approximately <br />200' previously, the minimum distance to those lots would now <br />be 230 feet; and <br />WHEREAS, in addition to requesting the new street design the applicant <br />has asked that Condition No. 5 of case PUD-80-1 be removed <br />since there is no longer a need for a connector between the <br />two semi-circular streets; and <br />WHEREAS, the applicant also asked that Condition No. 37 pertaining to <br />the design of the sanitary sewer line serving the property <br />be eliminated since an alternate design has subsequently <br />been approved; and <br />WHEREAS, the Director of Planning and Community Development, after <br />consultation with the City Attorney and Director of Public <br />Works and Utilities, determined that the abovementioned <br />changes are nonsubstantial in nature, therefore, in accord- <br />ance with Section 2-8.32, Article 2, Title II of the Ordinance <br />Code of the City of Pleasanton, granted a minor modification <br />to case PUD-80-1 with the understanding that no other condi- <br />tions of approval beyond those mentioned above are being <br />modified - all conditions pertaining to truck traffic, the <br />30' landscape buffer, private streets, maintenance of common <br />area landscaping, street maintenance, hours of operation, <br />hours of construction, building heights, the 75' building <br />setback on the west, etc. remain as originally approved in <br />case PUD-80-1 and PUD-79-13. <br />NOW, <br />
