PLANNING COMMISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION N0. 2012 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RECOMMENDING APPROVAL OF A NEGATIVE DECLARATION PREPARED FOR CASE RZ-81-8 FILED BY BILLY R. NEWMAN WHEREAS, Billy R. Newman has applied to rezone a 5.1± acre site located at 5130 Foothill Road from "Agricultural" to "R-1-40,000," (Single-Family Residential) District or to any other zoning district consistent with the General Plan; and WHEREAS, a public hearing was held on June 10, 1981 at which time all testimony and exhibits were presented and considered; and WHEREAS, said proposal was based upon an Initial Study done pursuant to the Environmental Impact Guidelines and Procedures adopted by the City Council of the City of Pleasanton by Resolution No. 77-66; and _ WHEREAS, the Planning Commission, at its meeting of June 10, 1981, received the Initial Study and proposed Negative Declara- tion in a report from the Director of Planning and Community Development dated June 10, 1981 regarding the aforementioned project; and WHEREAS, the Planning Commission was advised by the City Attorney or its responsibilities in reviewing the proposed Negative Declaration and the determinations required by Section 5.4 (e) of Resolution No. 77-66; and WHEREAS, each member of the Planning Commission had before him/her copies of Resolution No. 77-66 at the time of considering the proposed Negative Declaration and Initial Study; and WHEREAS, the public was afforded an opportunity to comment on the proposed environmental assessment, which had previously been published in the Pleasanton Times, at the time of the public hearing on the aforementioned project; and WHEREAS, upon receipt of the staff report and public input, the Planning Commission reviewed the provision of the City's Guidelines and Processing Procedures for the evaluation of projects and preparation of Environmental Impact Reports as they pertain to requirements for Negative Declarations and Environmental Impact Reports in order to determine if - a Negative Declaration is appropriate for the project and what mitigation measures, if any, must be undertaken to ensure that the project will not have a significant impact upon the environment. ///
