EXHIBIT "A" <br />PLANNING COMMISSION RESOLUTION N0. 2510 <br />PUD-84-5 <br />1. That the development shall be substantially as shown on the <br />development plan, Exhibit A, on file with the Planning <br />Department except that lots 103 through 110 and the <br />streets serving them shall be eliminated. <br />2. That no construction shall begin on the subject property <br />until construction has commenced on the improvements <br />necessary to connect Bernal Avenue with Valley Avenue and <br />that no units shall be occupied until the Bernal Avenue/ <br />Valley Avenue connection is complete. <br />3. That no more than 50 dwelling units shall be constructed <br />on the subject property until canstruction has begun on <br />the extension of Bernal Avenue from the western boundary <br />of the subject site to its present terminus adjacent to <br />the Old Towne Development. Occupancy of the 51st unit <br />in the project shall not take place until this connection <br />is complete. The connection need not be the fully improved <br />84 ft. wide street, but shall be improved to the extent <br />deemed necessary by the City Engineer. The developer is <br />obligated to exert his best faith efforts to develop an <br />appropriate funding mechanism for construction of the <br />connection as expeditiously as possible. <br />4. That development of the subject property shall be in <br />accordance with all recommendation of the Geological <br />Feasibility Study prepared by Merrill, Seely, Inc., dated <br />May 10, 1984. <br />5. That detailed project specific geotechnical studies shall <br />be conducted prior to development of the site. These studies <br />shall include subsurface exploration including exploratory <br />borings, and laboratory testing. <br />The developer shall follow all recommendations of these <br />subsequent geotechnical investigations. <br />6. That the tentative map submitted for the project shall <br />show building pad areas for all custom lots and that no <br />structure shall be built outside of these pad areas with <br />the exception of fencing approved by the Planning Department. <br />7. That the colors and building materials for all homes shall <br />be submitted to the Planning Department for approval prior <br />to issuance of a building permit. <br />
