~- PLANNING COMMISSION
CITY OF PLEASANTON
COUNTY OF ALAMEDA
STATE OF CALIFORNIA
RESOLUTION NO. 2555
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PLEASANTON UPHOLDING THE APPEAL OF ALLAN AND SUZANNE
COFER ET AL FOR MODIFICATION TO CASE PUD-81-29
WHEREAS, on June 19, 1984 the Zoning Administrator grantd a minor
modification to case PUD-81-29, the planned unit
development governing the Amador Meadows project located
in he area bounded by Rheem Drive, Oakland Avenue and
Kamp Drive which established the location of the
exterior side yard fences of lots 60, 61, 70, 74, 77,
81 and 99 in that development; and
WHEREAS, sideyard fences on corner lots are normally required to
be setback at least 10 ft. from the exterior side
property line but in the case of these particular lots
Homestead Development Company, builder of the Amador
Meadows project constructed them so that their setbacks
range from approximately 2 ft. to 7-1/2 ft. The
modification which was granted on June 19 required the
fences to be moved back to the 10 ft. set back line
unless such a move would have placed a fence less than 5
ft. from the adjacent dwelling unit. Many of the
dwelling units are close enough to the property line
that the fences cannot be moved back to the 10 ft.
setback line; and
WHEREAS, the modification was granted to Homestead Development
Company and when the affected property owners learned of
it, many of them did not concur with the Zoning
Administrator's decision, therefore, another application
for modification was submitted by four of the seven
property owners involved in he original modification
request. This application was by the owners of lots 61,
77, 81 and 99. In his second modification, the owners
asked that the PUD be modified so that none of the
fences would have to be moved in any way; and
WHEREAS, The request for modification by the four homeowners was
considered by the Zoning Administrator on 8/30/84 and
rather than granting the modification so the fences
could remain exactly as now constructed, the Zoning
Administrator granted a modification to allow a 5 ft.
setback between the fences and the exterior side
property line of all 7 lots involved in the original
Homestead application. In two of the cases, Jameyson
(lot 62) and Cofer (lot 99, the fence setback would be
less than 5 ft; and
