~- PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2555 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON UPHOLDING THE APPEAL OF ALLAN AND SUZANNE <br />COFER ET AL FOR MODIFICATION TO CASE PUD-81-29 <br />WHEREAS, on June 19, 1984 the Zoning Administrator grantd a minor <br />modification to case PUD-81-29, the planned unit <br />development governing the Amador Meadows project located <br />in he area bounded by Rheem Drive, Oakland Avenue and <br />Kamp Drive which established the location of the <br />exterior side yard fences of lots 60, 61, 70, 74, 77, <br />81 and 99 in that development; and <br />WHEREAS, sideyard fences on corner lots are normally required to <br />be setback at least 10 ft. from the exterior side <br />property line but in the case of these particular lots <br />Homestead Development Company, builder of the Amador <br />Meadows project constructed them so that their setbacks <br />range from approximately 2 ft. to 7-1/2 ft. The <br />modification which was granted on June 19 required the <br />fences to be moved back to the 10 ft. set back line <br />unless such a move would have placed a fence less than 5 <br />ft. from the adjacent dwelling unit. Many of the <br />dwelling units are close enough to the property line <br />that the fences cannot be moved back to the 10 ft. <br />setback line; and <br />WHEREAS, the modification was granted to Homestead Development <br />Company and when the affected property owners learned of <br />it, many of them did not concur with the Zoning <br />Administrator's decision, therefore, another application <br />for modification was submitted by four of the seven <br />property owners involved in he original modification <br />request. This application was by the owners of lots 61, <br />77, 81 and 99. In his second modification, the owners <br />asked that the PUD be modified so that none of the <br />fences would have to be moved in any way; and <br />WHEREAS, The request for modification by the four homeowners was <br />considered by the Zoning Administrator on 8/30/84 and <br />rather than granting the modification so the fences <br />could remain exactly as now constructed, the Zoning <br />Administrator granted a modification to allow a 5 ft. <br />setback between the fences and the exterior side <br />property line of all 7 lots involved in the original <br />Homestead application. In two of the cases, Jameyson <br />(lot 62) and Cofer (lot 99, the fence setback would be <br />less than 5 ft; and <br />
