advise him with regard to the type of fencing which <br />~- could be installed around his rear yard. On June 1, <br />1984 the Planning Director went to the Owner's house to <br />discuss this matter. A long conversation took place at <br />which time the type of fencing allowed by the PUD was <br />clearly and thoroughly explained to Mr. Weber. He was <br />informed that open wrought iron fencing is all that is <br />allowed along his northern side property line and rear <br />property line. He indicated a desire to construct solid <br />woof fencing along these property lines and between his <br />northern property line and the front of his house in <br />order to provide privacy to his swimming pool that was <br />then under construction. It was explained to him that he <br />had the right to apply for a modification to the fencing <br />requirements of the PUD if he did not like the fencing <br />restrictions of the plan; and <br />WHEREAS, the property owner constructed a solid fencing around <br />his rear yard and did not apply for a modification to <br />the PUD; and <br />WHEREAS, the property owner was sent several letters requesting <br />that he either remove the fencing or apply for a <br />modification to the Planned Unit Development; and <br />WHEREAS, a modification application was filed with the City; and <br />WHEREAS, at their duly noticed public hearing of October 24, 1984 <br />the Planning Commission considered the request of the <br />property owner of 2492 Foothill Road. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Recommends approval of case PUD-79-2-4M, Victor <br />Weber, which will allow the retention of an existing <br />solid wood fence along his northern property line but <br />that wrought iron fencing meeting the Requirements of <br />the PUD be installed along the rear property line and <br />between the northern property line and the side of the <br />home and that the shrubs be planted along the exterior <br />of the northern property line fence and that an <br />acceptable means of irrigating these plants be provided. <br />Section 2. This resolution shall become effective immediately <br />upon its passage and adoption. <br />PASSED AND ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON ON THE 24TH DAY OF OCTOBER 1984 BY THE FOLLOWING VOTE: <br />AYES: Commissioners Getty, Lindsey, Wellman, and Chairman <br />Doherty <br />NOES: Commissioner Wilson <br />ABSENT: Commissioner Innes <br />ABSTAIN: None <br />
