~- PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2558 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RECOMMENDING APPROVAL OF A MODIFICATION TO <br />CASE PUD-79-2, THE TWELVE OAKS RESIDENTIAL SUBDIVISION <br />FOR VICTOR WEBER <br />WHEREAS, Condition No. 4 of the Twelve Oaks PUD (PUD-79-2) <br />regulates the type of fencing which may be constructed <br />in conjunction with the 28 single family residences <br />which will be built in that subdivision. Originally <br />condition number 4 read as follows: <br />"Where perimeter fencing around the perimeters of the 28 <br />individual lots is desired it shall be confined to low <br />split rail type fencing similar to that shown on the <br />development plan. Privacy shall be achieved mainly <br />through hedges and other types of landscaping. Safety <br />fencing around swimming pools should also be open in <br />nature (wrought iron or similar). All fencing shall be <br />subject to the approval of the Planning Division;" and <br />WHEREAS, modifications have been made to that condition and now <br />solid 6 ft. high fencing is allowed in some areas of the <br />development. Solid fencing is still prohibited around <br />the perimeters of the upper eleven lots of the <br />subdivision (those on Twelve Oaks Drive) but is now <br />allowed between homes on the lower seventeen lots (those <br />with access to Foothill Road, Gloria Court and Dorothea <br />Court); and <br />WHEREAS, in other locations on the lower 17 lots only open <br />wrought iron fencing a maximum of 6 ft. in height is <br />permitted. This includes along rear property lines, <br />between side property lines and homes and along interior <br />side property lines where the bases of fences would be <br />more than 4 ft. higher than the average finished floor <br />elevation of the lower principal structure between which <br />such a fence would be located. In front yards other <br />fencing materials may be used but all fences still have <br />to be open and cannot exceed 3 ft. in height. There is <br />one exception to these standards; solid wood fencing has <br />been allowed along the ear property lines of lots 5 <br />through 8, located at the northwest corner of Longview <br />Drive and Foothill Road, since the rear yards in these <br />locations back up to Foothill Road and there would be no <br />privacy for them whatsoever without a solid fence; and <br />WHEREAS, the owner of the northernmost lower lot in the Twelve <br />Oaks subdivision (lot 17), requested that the staff <br />
