PUD-84-13 <br />1. That the development be substantially as shown on the <br />development plan, Exhibit A (including Alternative D Master <br />Site Plan) on file with the Planning Department. <br />2. That that portion of the public park extending from the <br />corner of Bernal Avenue and Tawny Drive, eastward to the <br />main body of the park site shall be privately owned land <br />maintained by the homeowners association of the 84 unit <br />multi-family project. <br />3. That design plans for the precast wall proposed to separate <br />the housing units from the City park, shall be submitted to <br />the Planning Department for approval prior to issuance of a <br />building permit. <br />4. That instead of a precast wall, a maximum 6 ft. high wrought <br />iron fence shall be constructed along the southern perimeter <br />of the subject property between the dwelling units and Tawny <br />Drive and this fence shall be lowered to a maximum of 30 <br />inches in height along the Bernal Avenue and Vineyard Avenue <br />frontages of the subject property. <br />5. That all parking spaces within garages shall be a minimum of <br />10 ft. by 20 ft. in size. <br />6. That prior to the filing of a final map on the subject <br />property, CC&Rs shall be approved by the City Attorney; <br />these CC&Rs shall provide for a property owners association <br />with sufficient power to manage all commonly owned areas. <br />The City shall be named as third party beneficiary of said <br />CC&Rs and shall be granted the power to enforce its <br />provisions if the property owners association fails to do <br />so. <br />7. That the emergency access road to Bernal Avenue shall be <br />deleted and the emergency access road to Tawny Drive shall <br />be a paved decorative surface meeting the requirements of <br />the Fire Department. <br />8. That all Fire Department access roads (20 ft. by 13 ft. 6 <br />in.) are hereby declared fire lanes and must be maintained <br />accessible at all times. Curbs shall be painted red and NO <br />PARKING signs shall be provided to City standards. <br />
