However, this danger can be substantially reduced if the City now enters into a negotiated agreement with the State's contractor to construct the elements of the Stoneridge Drive Interchange within the present State right of way. This arrangement would provide the following: 1. Maintain full width traffic lanes throughout the entire construction; 2. Maintain full shoulder widths during the entire construction; 3. Eliminate the need to remove construction elements completed by Caltrans; 4. Reduce by more than three months the exposure of the travelling public to highway construction hazards;. and 5. Eliminate any long term dangers related to remnants of temporary striping. E. The City Council finds that the State's contractor, Oliver de Silva, Inc. is on the site, has the ability to perform this work, and is the logical company to carry out this emergency construction work because of the need to eliminate potential dangers to the motoring public and the need to eliminate work being duplicated. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The plans and specifications for the construction of portions of the 1-680/Stoneridge Drive interchange within the Caltrans right of way are approved. Section 2: Based on the recitals set forth in this resolution, an emergency exists which warrants prompt action on the City's part and a waiver of the competitive bidding procedures. Section 3: The City Manager is authorized to negotiate a construction contract with Oliver de Silva, Inc. based on the plans and specifications in Section 1, above, in an amount not to exceed the Engine~r's estimate for such work. -2-
