3. That approval of the development plan for case <br />PUD-85-1 constitutes approval for both phases of <br />development even though Phase 2 may not follow for <br />several years. <br />4. That no on-site or off-site grading shall take place <br />on the subject property without prior City approval. <br />5. That no improvement activities, including but not <br />limited to grading, construction, tree removal or <br />site preparation shall be initiated until all proper <br />City permits have been obtained. <br />6. That the design of the 6 ft. high masonry wall shown <br />along the Southern Pacific Transportation Company <br />right-of-way and along Mohr Avenue adjacent to the <br />attached single family residences shall be submitted <br />to the Planning Department for approval prior to <br />approval of the tentative map. <br />7. That where the setback of any garage is less than 23 <br />ft., roll-up type garage doors shall be used. <br />8. That the development shall be subject to the siting <br />standards shown on page 3 of the development plan. <br />Except as otherwise established by the conditions of <br />approval of case PUD-85-1, the uses and site <br />standards for the detached single-family residential <br />portion of the project shall be those of the <br />R-1-7500 District and the uses and site standards of <br />the paired single-family residential portion shall <br />be those of the RM-4000 District. <br />9. That final elevations for all paired single-family <br />residences shall be submitted to the Planning <br />Department for approval prior to issuance of any <br />building permits. <br />10. That a homeowners association comprised of owners of <br />the paired single-family residences shall be <br />established for maintenance of all commonly owned <br />areas and that the CC&Rs of the development shall be <br />submitted to the City for approval prior to <br />submittal of a final map. That the City shall be <br />named as third party beneficiary of the CC&Rs and <br />granted the power to enforce their provisions if the <br />homeowners association fails to do so. <br />11. That a final landscape plan for the development <br />shall be submitted to the Planning Department for <br />approval prior to issuance of building permits. <br />- 2 - <br />
